SPI summary

Royal Decree 1055/2022 extends EPR to all packaging and sets national reuse targets, including 20% reusable commercial and industrial packaging in 2030 and 30% in 2035.

In practice

Royal Decree 1055/2022, in force since 29 December 2022, covers all packaging placed on the Spanish market and extends extended producer responsibility to commercial and industrial packaging, alongside household packaging. Producers register in the packaging section of the Registro de Productores de Producto and report annually. Article 8 sets reuse targets: 20% reusable commercial and industrial packaging by weight in 2030 and 30% in 2035, plus HORECA beverage, household beverage and household packaging targets. These national rules now operate alongside the PPWR, which applies from 12 August 2026.

Who is in scope

  • All packaging placed on the market and packaging waste generated in Spain, household, commercial and industrial (art. 3)
  • Packaging producers: registration in the Registro de Productores de Producto and annual reporting
  • Reuse targets (art. 8.1): commercial and industrial 20% (2030) and 30% (2035); household packaging 5% (2030) and 10% (2035); household beverages 10% in 2030
  • HORECA beverages (art. 8.1.a), e.g. beer 80% (2025), 85% (2030), 90% (2035); water 30%, 40%, 50%

Who is not

  • Health centres may still sell beverages in single-use packaging (art. 7.1.a)
  • Applies without prejudice to special rules on safety, health, medicines, transport and hazardous waste (art. 3.2)
