SPI summary
Producers must meet recovery (aprovechamiento) targets for packaging waste, measured against the weight placed on the market in a base year, through individual or collective management plans. Resolution 803 of 24 June 2024 modified articles 2, 3, 6, 8 and 9, including adding Article 9(b) targets for plastic packaging and single-use plastic products, and set new plan filing deadlines.
In practice
Producers placing packaging and, since Resolution 803 of 2024, single-use plastic products on the Colombian market must run individual or collective management plans, file them with ANLA and report progress each year against recovery targets for paper, board, glass, metal and plastic. Targets are measured against tonnage placed on the market in a base year, so accurate market data by material and resin is central. Converters, manufacturers and importers of packaging also carry their own duties under the resolution.
Where the record is unclear
- The target percentages are in image tables (Tabla 1 and Tabla 1-a) that are not reproduced as text on the source page.
- The normograma marks Article 2 as repealed while also showing new Article 2 text, so its consolidated status is ambiguous.
- The progress report schedule table on the source page is partly garbled and should be checked against the official Diario Oficial version.

Overview
Resolution 1407 was issued by the Ministry of Environment and Sustainable Development on 26 July 2018 and applies from its publication in Diario Oficial 50.673 on 2 August 2018 (Art. 19)1. Its legal basis is Article 38 of Decree-Law 2811 of 1974, Article 5 of Law 99 of 1993 and Decree-Law 3570 of 2011, framed by Articles 79 and 80 of the Constitution and the CONPES 3874 policy of 2016 on solid waste1. Two later resolutions changed it: Resolution 1342 of 2020 and Resolution 803 of 2024, which brought single-use plastic products into scope and gave plastics their own targets in Article 9, literal b12.
The instrument works through a plan, the PGAREE, rather than a fee. Each producer files an individual plan or joins a collective one with ANLA, the national environmental licensing authority, through the VITAL online window, and then reports progress every year (Arts. 4, 7)12. Collective plans that fall short on tonnage can make up part of the gap through a multicriteria evaluation that needs at least 110 points, where 100 points equals the recycling target, but the method is unavailable below 70% of the quantitative target (Art. 10)12.
ANLA's page states there is no minimum or maximum volume threshold for filing, so a small brand owner is in scope from its first unit2. Since 2025, progress reports must use the Resolution 803 formats2.
Who must do what
Producer (own-brand manufacturer, importer, brand owner or first placer of single-use packaging)
- Formulate, implement and keep current an individual or collective plan, file it with ANLA, and promote recycling alliances and eco-design (Arts. 4 and 11)1.
- Report progress for 1 January to 31 December each year through VITAL using Annex III (Art. 7)1.
- Extend collection coverage to San Andrés and to the cities phased in between 2023 and 2028 (Art. 9)1.
Commercialiser or retailer
- Support producers' plans, offer space for collection points and tell consumers how to return packaging (Art. 12)1.
Packaging manufacturer or importer
- Support producers' plans, research and consumer awareness programmes (Art. 13)1.
Transformer (recycler using recovered material)
- Certify the recovered material it receives, register with the regional or urban environmental authority by 31 March, and report material changes (Art. 15)1.
Are you in scope?
Work through each question. The answers are the SPI team's reading of the sources cited.
Do you place packaged goods, or single-use plastic products, on the Colombian market for a final consumer?
- If no
- Other value-chain roles may still carry duties under Articles 12 to 151.
Is the packaging hazardous waste?
Is it wood or natural textile packaging other than paper and board?
- If no
- Paper, board, plastic, glass and metal are covered1.
Is it primary packaging for medicines?
Did you exist as a producer at 31 December 2022?
Compliance checklist
Confirm the plan route
By NowSPI analysis of the official text. Not legal advice; confirm with the text or counsel. Decide between an individual plan and a collective plan, noting that collective plan members carry joint and several liability (Art. 5)1.
Evidence to keep Plan file number and collective agreement, if any.
Build the baseline
By Before filing or updating the planArticle 6 requires the baseline of materials placed on the market alongside governance, logistics and financing1.
Evidence to keep Base-year tonnage by material and plastic resin.
File the annual progress report
By March or April each yearDigits 1 to 5 in the fourth position of the file number report in March, digits 6 to 0 in April, using the Resolution 803 annexes2.
Evidence to keep VITAL filing receipt and Annexes I to V.
Collect transformer certificates
By With each reportRecovered tonnage is backed by certificates from transformers registered with their environmental authority (Art. 15)1.
Evidence to keep Transformer certificates matched to reported tonnes.
Plan city coverage
By 2028Add the cities and San Andrés coverage that Article 9 phases in from 2023 to 20281.
Evidence to keep Coverage map by municipality and year.
Align with Law 2232 PET targets
By 2025 to 2040PET bottles for other beverages must contain at least 20% recycled content from 2025, rising to 60% by 2040 (Law 2232, Art. 17)3.
Evidence to keep Recycled content certificates for PET bottles.
Enforcement and penalties
- Who enforces
- Autoridad Nacional de Licencias Ambientales (ANLA)2
- Powers
- ANLA reviews plans and progress reports, may request more information before re-evaluating a plan, and may visit sites after written notice2. Monitoring of post-consumer plans carries fees under Resolution 1140 of 20222.
- Enforcement so far
- SPI knows of no published ANLA sanction under Resolution 1407 at 14 October 2026.
Penalties
How it fits with other rules
- Gradual ban on single-use plastic products (Law 2232 of 2022) PR-CO-002
Law 2232 of 2022 bans 14 single-use plastic items in two waves and sets PET and HDPE recycled content and collection goals in Article 17, including 50% collection of liquid containers by 20303. Resolution 803 of 2024 then folded single-use plastic products into the PGAREE plans, so one plan now reports both packaging and those products12. - Ley 1333 de 2009 (environmental sanctioning procedure)
ANLA uses the 2009 law to sanction plan failures, which means the fine depends on the general environmental scale rather than on a packaging-specific tariff2. - Packaging collection and recovery targets under Ley REP (DS 12/2020) PR-CL-001
Both countries measure recovery against tonnage placed on the market. Colombia lets collective plans count a multicriteria score towards the target, which Chile's decree does not offer (Art. 10)1.

Last city coverage step under Article 91.
Questions
Is there a minimum volume before a Colombian producer needs a packaging plan?
No. ANLA states that Resolution 1407 has no minimum or maximum volume threshold, so any producer placing packaged goods on the market for final consumers must file or join a plan2.
When are annual progress reports due?
In March or April, depending on the fourth digit of the plan's file number: digits 1 to 5 file in March and 6 to 0 in April. Reports cover 1 January to 31 December of the previous year and, since 2025, use the Resolution 803 formats2.
Can a collective plan meet its target without the full tonnage?
What happens if a producer misses a target?
Are medicine packs covered?
Primary pharmaceutical packaging is excluded, along with hazardous-waste packaging and wood or natural textile packaging other than paper and board, according to ANLA's guidance on Resolution 14072.
