SPI summary
Supreme Decree 12 sets collection and recovery targets for household and non-household packaging under the Extended Producer Responsibility Law 20.920. It was published on 16 March 2021 and the packaging targets apply from 16 September 2023.
In practice
Brand owners and importers that place packaged consumer goods on the Chilean market must organise and fund collection and recovery of that packaging through an authorised management system, either individually or collectively. Household and non-household packaging are treated separately, so companies need to know which category each pack falls into. Packaging design, material mix and the tonnage placed on the market drive the obligation, so converters supplying Chile-bound brands may receive more detailed data and design requests.
Who is in scope
- Producers placing on the Chilean market consumer goods packaged in liquid carton, metal, paper and board, plastic or glass (DS 12, Art. 7)
- Household packaging and non-household packaging; non-household covers only metal, paper and board, and plastic, while liquid carton and glass are always household (Art. 5)
- Secondary and tertiary packaging used to ship goods sold remotely to individuals, which counts as household (Art. 4)
- Collective management systems, including GRANSIC systems of 20 or more unrelated producers (Arts. 2 and 11)
Who is not
- Microenterprises as defined by Law 20.416 (Art. 7)
- Producers placing less than 300 kg of packaging a year are exempt from targets and associated obligations, but still report annually through the RETC (Arts. 7 and 10)
What to do and by when
- NowMap annual tonnage placed on the Chilean market by material and by household or non-household category.
- NowCheck whether the business falls under the 300 kg threshold or the microenterprise exemption, and confirm RETC registration and reporting.
- NowReview membership of a management system and note that switching requires notice to the Ministry before 30 June of the preceding year.
- NowBudget for rising fees as material-specific targets step up over time.
