In Spain the plastic tax is close to half the bill on plastic packaging, and the deposit system has no confirmed start
On a 180-tonne household packaging basket priced by Strategic Packaging Insights (SPI), a brand selling in Spain pays about EUR 46,628 in 2026 Ecoembes fees and EUR 29,250 in the EUR 0.45 per kg tax on non-recycled plastic, EUR 75,877.50 in all, while the deposit return system that press reports date to 22 November 2026 has no start date in any official act SPI has read.

The basket is an SPI assumption (Exhibit 2). All figures in EUR. The tax rate is set by Ley 7/2022 and applies from 1 January 2023.
Spain stacks three charges on the same pack: an extended producer responsibility (EPR) fee under Real Decreto 1055/2022, a state tax on non-reusable plastic packaging under Ley 7/2022, and a deposit system for drinks containers that the law requires but no operator yet runs. Plastic is 42% of the basket’s weight and 86% of its bill, so the decisions that move a Spanish budget are about plastic: how much, which format and how much of it carries an accredited recycled-content certificate.
Executive summary
A brand that sells packaged goods in Spain answers to two authorities for the same pack. MITECO, the environment ministry, runs the producer register and authorises the collective schemes (SCRAP) that collect EPR fees under Real Decreto 1055/2022. The Agencia Tributaria collects the special tax on non-reusable plastic packaging, set by articles 67 to 83 of Ley 7/2022 at EUR 0.45 per kilogram of non-recycled plastic. Since 12 August 2026 the EU Packaging and Packaging Waste Regulation (PPWR) sits above the decree, which MITECO says now applies only where the Regulation is silent or compatible (MITECO note, 19 May 2026).
SPI priced one basket of 180 tonnes of household packaging through Ecoembes’ 2026 table and the tax (Exhibit 2). The bill is EUR 75,877.50, or EUR 421.54 per tonne. The tax is EUR 29,250.00 of it, 38.5% of the total and 44.8% of the plastic bill. For PET drinks bottles and HDPE bottles the tax is larger than the scheme fee; for film the fee is nearly three times the tax.
The supply route decides who pays the tax and who files. A manufacturer in Spain pays it and files form 592; an importer from outside the EU settles it at customs; an intra-EU acquirer registers once non-recycled plastic passes 5 kg in a month (Exhibit 6). The brand is the producer for EPR in each case, and a seller with no Spanish establishment needs an authorised representative under PPWR article 44.2.
Recycled content pays twice, but unevenly. Raising the PET bottles from 25% to 50% certified recycled plastic saves EUR 4,500.00 in tax and EUR 93.22 in Ecoembes bonus (Exhibit 9). The tax saving depends on a certificate from an accredited entity, a tax matter that SPI describes but does not assess.
The deposit return system (SDDR) is the open line. MITECO’s November 2024 report restates the Ley 7/2022 rule that a missed 2023 bottle collection target brings a nationwide deposit system within two years. Press reports date the start to 22 November 2026, but SPI has not yet confirmed that date against a BOE act or MITECO resolution, and press reports of 11 October 2026 say no operator has been authorised (Exhibit 11). Budgets should hold the deposit as a cash-flow risk with no confirmed date.
Key findings
- SPI calculation: the 180-tonne basket costs EUR 75,877.50 in 2026, of which EUR 46,627.50 is Ecoembes fees and EUR 29,250.00 is plastic tax; plastic is 41.7% of the weight and 86.0% of the bill (Ecoembes Precios 2026; Agencia Tributaria, consulted 21 October 2026).
- The tax rate is EUR 0.45 per kg of non-recycled plastic, and recycled plastic leaves the base only if an accredited entity certifies it; a manufacturer’s own declaration sufficed only in the 12 months after 1 January 2023 (Agencia Tributaria).
- SPI analysis: the tax is 61.2% of the HDPE bottle line and 55.5% of the PET bottle line, but 26.6% of the film line, because Ecoembes charges film EUR 1,243 per tonne against EUR 285 for rigid HDPE (Exhibit 5).
- Ecoembes’ published 2027 table moves the basket fee up 2.3%, to EUR 47,711.30, with glass up 7.0% and PET trays up 3.5%, while HDPE falls 1.1% (Ecoembes Precios 2027, published August 2026).
- SPI calculation: losing certificates on the PET bottles adds EUR 4,500.00 to the bill; the high case (2027 rates, no certificates, a 10% malus on the trays) costs EUR 82,484.30, 8.7% above base, and the low case EUR 67,436.27, 11.1% below (Exhibit 10).
- MITECO’s 2023 bottle report records 214,039.33 tonnes of single-use plastic bottles placed on the market and 74,482 tonnes collected through local authorities (November 2024); SPI has not yet confirmed a 22 November 2026 deposit start in any official act.
Three charges, three collectors
Spain’s packaging costs come from three legal sources that do not share a collector, a base or a calendar. Treating them as one “packaging compliance” line hides which lever moves which euro.
The EPR fee. Real Decreto 1055/2022 of 27 December 2022 was published in the BOE on 28 December 2022 and entered into force the next day (BOE-A-2022-22690; PR-ES-002). It defines the producer of the product as the packer, or the business that imports or buys packaged goods in another Member State to sell them in Spain, and it splits packaging into household, commercial and industrial categories (articles 2.t, 2.m, 2.h and 2.n, as read in SPI’s fee-market notes of 14 October 2026). Producers register in the packaging section of the Registro de Productores de Producto and meet their duties through an individual or collective SCRAP. Commercial and industrial packaging has needed SCRAP membership since 31 December 2024 under the third transitional provision (MITECO register page, consulted 14 October 2026).
The schemes are concentrated in household packaging and spread out in industrial packaging. MITECO’s market share resolution for 2025, signed on 15 July 2026, lists 9 schemes for household single-use packaging, with Ecoembes at 55.6% and Ecovidrio at 40.4%; 17 for commercial packaging, where Ecoembes Comercial holds 77.5%; and 16 for industrial packaging, where Envalora holds 37.5%, Cartón Circular 20.5% and GENCI 17.1% (MITECO resolution, consulted 21 October 2026).
The plastic tax. The special tax on non-reusable plastic packaging is set in Chapter I of Title VII of Ley 7/2022, articles 67 to 83, and has applied since 1 January 2023 (PR-ES-001). It falls on the manufacture, import or intra-EU acquisition of non-reusable packaging that contains plastic, empty or filled, and on plastic semi-finished products and closures for such packaging. Its base is the kilograms of non-recycled plastic in the taxed product (article 77), and its rate is EUR 0.45 per kilogram (Agencia Tributaria, consulted 21 October 2026). It borrows its definition of packaging from article 2.f of the decree, so the new decree MITECO is drafting could move the tax base as well.
The deposit. Ley 7/2022 sets separate collection targets for single-use plastic bottles: 70% by weight in 2023, 77% in 2025, 85% in 2027 and 90% in 2029, as the decree’s preamble restates (BOE-A-2022-22690). Missing the 2023 or 2027 target brings in a nationwide deposit, return and refund system within two years (MITECO 2023 bottle report). The decree’s chapter on the system, articles 46 to 48, governs how it runs, and article 13.2 requires packaging in the system to carry its symbol.
A fourth charge sits above the brand. Spain pays the EU plastic own resource at EUR 0.80 per kg of non-recycled plastic packaging waste, less an annual lump sum of EUR 142 million under Decision 2020/2053, and the Commission’s COM(2025) 574 would raise the rate to EUR 1 per kg from 2028 (PR-EU-017; PR-EU-018). The state pays it, not companies, so it is outside the basket.
The worked basket
SPI built one basket to show how the charges combine (Exhibit 2). It is an SPI assumption for a mid-sized food and drinks brand, not a market average, and every rate comes from a published table in one currency, the euro.

Household packaging only. Recycled share means plastic covered by an accredited certificate. Glass jars assumed at 300 g each, so 100,000 units. Commercial and industrial packaging are left out.
Ecoembes publishes one price per kilogram for each material and format, with separate lines for packaging inside the Single-Use Plastics Directive scope, marked SUP (Ecoembes Precios 2026). The PDF tables carry their material headings as images, so SPI matches lines by position across the 2025, 2026 and 2027 tables, which share one layout; the constant SUP gap of EUR 0.011 per kg in 2026 and 2027 confirms the match (SPI fee-market notes, 14 October 2026). Exhibit 3 shows the rates used.
| Line | 2025 | 2026 | 2027 | Change 2026 to 2027 (%) |

Household lines, excl. VAT, before eco-modulation. Per-kg rates x1000. 2025 values as matched by SPI on 14 Oct 2026; 2026 and 2027 consulted 21 Oct 2026. Glass also pays a per-unit factor, shown per 1,000 units. Paper 2025 not matched by SPI.
The 2026 table was a cut for drinks packaging. The SUP surcharge over the matching non-SUP line fell from EUR 0.101 per kg in 2025 to EUR 0.011 in 2026, so PET drinks bottles dropped 29.6%, from EUR 385 to EUR 271 per tonne, and aluminium cans fell from EUR 60 to EUR 40 (Ecoembes Precios 2025 and 2026). Mainstream plastic lines moved less: flexible film fell 1.9% and PET trays 1.8%.
The 2027 table, published in August 2026, reverses part of that. PET drinks bottles rise to EUR 278 per tonne, trays to EUR 682 and film to EUR 1,269, while HDPE eases to EUR 282 and the metal lines hold (Ecoembes Precios 2027, consulted 21 October 2026). Glass rises on both factors, to EUR 0.03761 per kg plus EUR 0.00533 per unit.

Exhibit 4 prices each line. The tax applies only to the plastic lines, and only to their non-recycled kilograms.

EUR only. Fee = tonnes x 1000 x Ecoembes rate per kg; glass adds 100,000 units x EUR 0.00498. Tax = non-recycled kg x EUR 0.45; PET bottles have 25% certified recycled content. Before eco-modulation, excl. VAT.
The arithmetic is short. PET bottles: 40,000 kg x EUR 0.271 = EUR 10,840 in fees, and 30,000 kg of non-recycled plastic x EUR 0.45 = EUR 13,500 in tax. Film: 10,000 kg x EUR 1.243 = EUR 12,430, plus 10,000 kg x EUR 0.45 = EUR 4,500. Glass: 30,000 kg x EUR 0.03515 + 100,000 units x EUR 0.00498 = EUR 1,552.50. Paper and board, at a third of the weight, is 9.1% of the bill.
SPI analysis
The two charges respond to different levers. The tax is flat across formats at EUR 450 per tonne of virgin plastic, so it rewards less plastic and more certified recycled plastic, whatever the format. The Ecoembes fee varies 4.6 times between PET drinks bottles (EUR 271) and film (EUR 1,243), so it rewards format choice. For rigid bottles the tax is the bigger lever; for film and trays the fee is.
A useful break-even falls out of the rates. At 0% recycled content the tax on a PET bottle (EUR 450 per tonne) is 1.66 times its Ecoembes fee (EUR 271). Above 39.8% certified recycled content, the tax falls below the fee; for HDPE the crossover is 36.7%. For trays and film the fee stays above the tax even at 0% recycled content.
In practice: Ecoembes.
Ecoembes holds 55.6% of Spanish household single-use packaging and, as Ecoembes Comercial, 77.5% of commercial packaging in MITECO’s 2025 resolution. Its commercial table charges nothing on kilograms that reach final holders who manage more than 85% of their own waste under a signed agreement, with large retail outlets given as the example, and its list of such holders for 2026 was open for update until 30 September (Ecoembes Precios 2026). The 2027 table adds a surcharge of EUR 0.052 per kg for commercial packaging managed as hazardous waste through municipal clean points (Ecoembes Precios 2027).
Four supply routes, four ways to pay
The tax is levied on whoever manufactures, imports or acquires the packaging from another EU state, not on the brand as such, and the EPR duty falls on the producer of the packaged product. SPI groups brands into four routes, each with a different filing burden (Exhibit 6).
| Route | Who owes the plastic tax | Tax filing | EPR duty under RD 1055/2022 |
|---|---|---|---|
| A. Spanish brand buying packaging made in Spain | The packaging manufacturer, per establishment | Registers, CIP code ending FP; form 592 each period, nil periods included | Brand registers as producer, ENV number on invoices, joins a SCRAP |
| B. Brand importing packed goods from outside the EU | The importer | Net kg of non-recycled plastic on the customs declaration (box 47, code 1PL); customs settles; no registration | Importer is the producer; registers and reports |
| C. Brand buying packed goods from another EU state | The intra-EU acquirer | Registers and files form 592 once non-recycled plastic passes 5 kg in a month; CIP code ending AP | Acquirer is the producer; registers and reports |
| D. Seller with no Spanish establishment selling to end users | A representative of the non-established taxpayer | Representative registers, CIP code ending RP | Authorised representative under PPWR article 44.2 registers and reports (article 17.2) |

SPI segmentation for planning, not legal advice. CIP codes are the tax register codes the Agencia Tributaria assigns. Check with counsel for any specific structure.
Route A is the common one for Spanish brands. The converter pays the tax and the brand meets it in the purchase price. The Agencia Tributaria lists an obligation to pass the tax on (“repercusión”), but SPI has not yet confirmed how converters show it on invoices, so the basket assumes the full tax reaches the brand. Manufacturers file one form 592 per establishment unless authorised to centralise, and excess deductions can be offset over the next 4 years or refunded in the last period of the calendar year (Agencia Tributaria, Liquidación y pago).
Route B is lighter on paperwork and heavier on precision. Customs settles the tax on the import declaration, and the tax forms part of the VAT base on import (Agencia Tributaria import guide, consulted 14 October 2026). The 5 kg monthly exemption covers imports only up to that level; above it, every kilogram is taxed, including the initial 5 kg.
Route C turns a brand into a taxpayer. Intra-EU acquisitions are exempt where non-recycled plastic does not exceed 5 kg in a month, and also where the goods are sent out of Spain or destroyed before the filing deadline for the period (Agencia Tributaria, Supuestos de exención). Above that, the acquirer registers, keeps the stock ledger set by Orden HFP/1314/2022 and files.
Route D has grown since 12 August 2026. MITECO says operators outside Spain that make packaged products available directly to end users in Spain must appoint an authorised representative, citing PPWR article 44.2, and the representative registers and reports under article 17.2 of the decree (MITECO register page). MITECO published an interpretative note on the PPWR producer definition for registration on 13 August 2026.
Exemptions cut across routes. Packaging for medicines, medical devices, special medical foods, hospital infant formula and hazardous healthcare waste is exempt, as are silage bale rolls, subject to the buyer’s prior declaration of use (Agencia Tributaria). Misuse of a declared exemption is a serious tax infraction fined at 150% of the unpaid tax, with a EUR 1,000 minimum.
In practice: Kraft Heinz.
The SPI Packaging Buyers Database lists H. J. Heinz Foods Spain S.L.U. among Kraft Heinz subsidiaries, and notes that the EUR 0.45 per kg tax falls on plastic ketchup and sauce bottles placed on the Spanish market (Kraft Heinz profile, 14 October 2026). The same profile records 222,000 tonnes of plastic packaging group-wide in 2024 and 22% recycled or renewable content across packaging, on industry-average recycled content. A group figure of that kind does not reduce Spanish tax; only plastic covered by an accredited certificate for the specific supply does.
In practice: Kimberly-Clark.
Kimberly-Clark lists subsidiaries in Spain, and SPI’s profile notes that the Spanish tax applies to the non-recycled plastic in diaper and wipes film (Kimberly-Clark profile, 14 October 2026). Part of its European tissue business moved into a joint venture with Suzano on 1 July 2026, which changes who is the producer for those lines. SPI has not yet confirmed which entities moved, which is the question each new owner’s registration and SCRAP contracts must answer.
The decree's other duties: reuse, labelling and reporting
Fees and tax are the priced part of the stack. Real Decreto 1055/2022 also imposes duties that cost staff time, shelf space or redesign, and most remain in force alongside the PPWR (Exhibit 7).
| Duty | Who | Article | Date or status |
|---|---|---|---|
| Register; show the ENV registration number on invoices | Producers | 15 | In force |
| Report packaging placed on the market; simplified form under 15 t | Producers or representatives | 16 | 2026 data: 2 Jan to 31 Mar 2027 |

| No "respetuoso con el medio ambiente" or similar marking | Producers | 13.3 | In force |
| Optional marking of recycled-content percentage | Producers | 13.6 | In force |
| Loose sale of whole fresh fruit and vegetables | Food retailers | 7 | In force, with exceptions |
| 20% of sales area for unpackaged or reusable offers, shops of 400 m2 or more | Food retailers | 7 | In force |
| Reusable beverage references by shop size | Food retailers | 9 | 300 m2 or more since 1 Jan 2025; smaller shops from 1 Jan 2027 |

Source: BOE-A-2022-22690 (consulted 21 Oct 2026); MITECO register page and note of 19 May 2026; SPI rule note PR-ES-002, checked 29 Oct 2026.
Article numbers as in the decree. Where the PPWR regulates the same point, MITECO says the EU rule prevails. SPI analysis, not legal advice.
Reporting. The register accepts 2026 data from 2 January to 31 March 2027, with a simplified form for producers under 15 tonnes, and MITECO treats a missed deadline as an administrative infraction under article 108 of Ley 7/2022 (MITECO register page). Category and SCRAP changes go through an ordinary window from 1 October to 31 December each year, so the 2026 window is open now. A SCRAP adhesion certificate must reach the register within one month of contracting (SPI fee-market notes).
Labelling. Article 13.2 says household packaging must show the fraction or container it goes in, and packaging in a deposit system must show that system’s symbol. Article 13.3 bans marking packaging “respetuoso con el medio ambiente” or with any equivalent wording that could encourage littering, and article 13.6 lets packaging state its recycled-content percentage (BOE-A-2022-22690). MITECO’s note says the PPWR’s labelling provisions apply in 2027, 2028 or 2029 under its article 12, which leaves the decree’s marking rules in place until then (MITECO note, 19 May 2026).
A recycled-content percentage printed on a pack and a recycled-content certificate for the tax are different things. The tax needs a certificate from an accredited entity for the plastic actually supplied; an on-pack percentage is a consumer statement under article 13.6. SPI makes no testing claim about either and sees them as separate evidence files.
Reuse. Article 9 requires food shops of 300 m2 to under 1,000 m2 to offer at least 4 reusable beverage references, 5 in shops up to 2,500 m2 and 7 above that, since 1 January 2025; from 1 January 2027 shops under 300 m2 need 1 to 3 (PR-ES-002). Article 8 sets reuse shares by channel, and SPI’s rule note records 20% and 30% targets for commercial and industrial packaging, which run alongside PPWR reuse obligations from 2030 (PR-EU-006).
SPI analysis
Reusable packaging is outside the plastic tax, which applies only to non-reusable packaging. For a brand already obliged to put reusable references on Spanish shelves, each reusable unit removes plastic from the tax base as well as meeting article 9. SPI has not priced reuse systems here, because their cost depends on return logistics that no public table shows.
The decree also faces replacement. MITECO held a prior public consultation on a new packaging decree from 5 May to 5 June 2025 and, in its note of 19 May 2026, says it is drafting one. Because the tax takes its packaging definition from article 2.f of the decree, a change of definition in the new text would move the tax base too.
Recycled content pays twice, but not equally
Ecoembes modulates its base price per packaging element. The guide applies from January 2024 and is calibrated on final annual declaration data for year n-2, and the money raised from penalised tonnes caps the bonuses paid in the same fraction (Ecoembes Guía de ecomodulación 2026). Exhibit 8 sets out the criteria.
| Fraction | Bonus criteria | Bonus per criterion | Maximum bonus | Maximum bonus on the basket line, EUR |
|---|---|---|---|---|
| PET bottles, not trays | Clear or light blue; recycled PET above 25% | 0.43 | 0.86 | 93.22 |
| PET trays | Mono-material; recycled PET above 25% | 3.3 | 6.6 | 652.41 |
| HDPE | Natural colour; recycled HDPE above 20% | 1.6 | 3.2 | 91.2 |
| Flexible plastic | Clear or natural; recycled film above 20% (above 50% for UNE bags) | 2.19 | 4.38 | 544.43 |
| Other rigid plastics (PP, PS, PVC) | Natural or clear; recycled content above 20% | 3.86 | 7.72 | no data |
Source: Ecoembes: Guía de ecomodulación 2026, consulted, checked 29 Oct 2026.
Each criterion earns its bonus once; a penalty cancels all bonuses and penalties do not stack. Paper and board earn no bonus; composites under 85% fibre are penalised. EUR values apply the maximum to the SPI basket at 2026 rates.
The malus triggers are opacity or colour (carbon black for HDPE), multi-material construction including EVOH of 5% or more, labels covering two-thirds or more of the body unless designed for separation, and PVC, rubber, silicone or metal accessories (Ecoembes guide). On the basket, a 10% malus on the trays would add EUR 988.50.
Now set those bonuses against the tax (Exhibit 9). Each 10 points of certified recycled content cuts the tax by EUR 45 per tonne of plastic, on every format.
| Certified recycled share (%) | Plastic tax | PET bottle Ecoembes fee | Tax plus fee |
|---|---|---|---|
| 0 | 450 | 271 | 721 |
| 10 | 405 | 271 | 676 |
| 25 | 337.5 | 271 | 608.5 |

EUR only. Tax = (1 minus certified recycled share) x 1000 kg x EUR 0.45. The PET bottle fee includes the 0.43% recycled-content bonus only where recycled PET is above 25%; the clear-colour bonus is left out.
SPI calculation: moving the basket’s 40 tonnes of PET bottles from 25% to 50% certified recycled content cuts the tax by EUR 4,500.00 (10,000 kg x EUR 0.45) and earns at most EUR 93.22 in Ecoembes bonus if the bottles are also clear, a ratio of about 48 to 1. On trays the balance is closer: a mono-material tray at 30% recycled PET saves EUR 2,025.00 in tax and EUR 652.41 in bonus.
The basket also shows a threshold trap. At exactly 25% recycled PET the bottles earn no Ecoembes recycled-content bonus, because the criterion is above 25%. The tax has no threshold, so it treats 25% and 26% almost the same.
SPI analysis
The tax saving is the larger prize, and it is also the more fragile one. The Agencia Tributaria fines false or incorrect certification at 50% of the unpaid tax, with a EUR 1,000 minimum, raised by 25% for repeat offences. Certification is a tax matter for the taxpayer and its accredited certifier; SPI does not test or certify recycled content, and a buyer should treat the certificate chain as part of its tax file.
Scenarios for 2027
SPI ran the basket through five cases that use only published rates, the published modulation and the tax rate, all in EUR (Exhibit 10).
| Case | Ecoembes fee | Plastic tax | Total | Per tonne | Change against base (%) |
|---|---|---|---|---|---|
| Low: more certified recycled content, 2026 rates | 45836.27 | 21600 | 67436.27 | 374.65 | -11.1 |
| Base: 2026 rates, PET bottles 25% certified | 46627.5 | 29250 | 75877.5 | 421.54 | 0 |
| Base at 2027 rates | 47711.3 | 29250 | 76961.3 | 427.56 | 1.4 |
| Certificates not accepted, 2026 rates | 46627.5 | 33750 | 80377.5 | 446.54 | 5.9 |
| High: 2027 rates, no certificates, tray malus | 48734.3 | 33750 | 82484.3 | 458.25 | 8.7 |
Source: SPI calculation from Ecoembes Precios 2026 and 2027, Guía de ecomodulación 2026 and the Agencia Tributaria rate, checked 29 Oct 2026.
EUR only. Low: 2026 rates; PET bottles 50% certified recycled and clear (0.86% bonus); trays mono-material at 30% (6.6%); HDPE at 25% (1.6%); film unchanged. High: 2027 rates; no certificates accepted; opaque trays (10% malus). Deposit costs left out (Exhibit 11).
Three results stand out. Ecoembes’ 2027 rates add only 2.3% to the fee and 1.4% to the whole bill. Losing certificates on one line, the PET bottles, adds more than the whole 2027 fee change: EUR 4,500.00 against EUR 1,083.80. And the spread between low and high, EUR 15,048.03, is 19.8% of the base bill, driven mostly by the tax.
SPI calculation: in the high case the tax is EUR 33,750.00, 40.9% of the bill, and the 10% tray malus at 2027 rates is EUR 1,023.00. In the low case the tax falls to EUR 21,600.00 and the bonuses are worth EUR 791.23 in all.
SPI analysis
For a Spanish budget, the reliable lever is the tax base, not the fee table. A brand that tracks certified recycled kilograms by supplier and lot controls a line that moves by thousands of euros on a basket this size, while scheme rates move by hundreds.
The deposit return system: what is confirmed
The deposit is the least settled layer. SPI’s own news log lists 22 November 2026 as the Spanish deposit start, and Spanish press reports use the same date. SPI checked it against official sources (Exhibit 11).

| EU rule | Deposit systems compulsory from 2029 unless 80% collection in 2026 and an exemption notified by 1 Jan 2028 | Official: PPWR article 50, Commission Notice |
Source: MITECO 2023 bottle report (November 2024); EUR-Lex Commission Notice C/2026/3084; El Español, 9 Oct 2026; Xataka, 24 Apr 2026; Qué!, 11 Oct 2026; Maldita, checked 29 Oct 2026.
Official means an act or report of a public authority. Press means a media report; SPI has not yet confirmed those points against an official act.
MITECO’s report is dated November 2024 with no day on its cover, and SPI has not yet confirmed the final 2023 collection rate in its text; press reports citing the ministry put it at 41.3%. A two-year count from that report points to November 2026, which is where the press date comes from. SPI has not yet confirmed 22 November 2026, or any other start date, against a BOE act or a MITECO resolution.
Readiness looks further off. Xataka reported on 24 April 2026 that Ecoembes, AECOC, Procircular and CorePET applied in May 2025 to the Comunidad de Madrid for authorisation as SCRAP to run the system, and that the regional government cited legal uncertainty. Qué! reported on 11 October 2026 that no operator had been designated and that operators estimate a start in late 2028 or early 2029. These are press reports, and SPI treats them as such.
The EU rule adds a second route to the same end. PPWR article 50 makes deposit systems compulsory for covered drinks containers from 2029, unless a Member State collects 80% of them for 2026 and notifies an exemption plan by 1 January 2028 (Commission Notice C/2026/3084; PR-EU-007). With a 2023 rate reported at 41.3%, SPI has not seen evidence that Spain is close to 80%.
SPI calculation: if the deposit were EUR 0.10, as press reports say the decree requires, and the basket’s PET bottles weighed 25 g each (an SPI assumption), the 40 tonnes would be 1.6 million bottles carrying EUR 160,000 of deposits. A deposit is refunded to the consumer who returns the container, so it is cash flow, not cost. The cost would be the system’s administration fee, which no authorised operator has published.
SPI analysis
The deposit also reshapes the EPR line. In the basket, PET drinks bottles and drinks cans carry EUR 13,010 of Ecoembes fees, 27.9% of the total fee. If those containers move into a deposit system, that fee would in principle give way to the system’s own charge, but SPI has not yet confirmed how the scope, fees or Ecoembes tables would change, so the basket keeps them in Ecoembes.
Industry reaction
“debe ser certificada por entidad debidamente acreditada para emitir la correspondiente certificación”
In English: “must be certified by an entity duly accredited to issue the corresponding certification”
The same page says that during the 12 months after the tax applied on 1 January 2023 a signed declaration from the manufacturer could serve instead, and that window has closed.
“está trabajando en la elaboración de un nuevo real decreto de envases y residuos de envases”
In English: “is working on drafting a new royal decree on packaging and packaging waste”
Until that decree arrives, the note says Real Decreto 1055/2022 continues to govern what the PPWR does not cover or does not contradict.
“se implantará en todo el territorio, en el plazo de dos años, un sistema de depósito, devolución y retorno”
In English: “a deposit, return and refund system will be introduced throughout the territory within two years”
The report ties that consequence to a missed 2023 or 2027 bottle target under Ley 7/2022, without naming a start date.
What leaders should do now
- Finance leads, by 31 December 2026: split the Spanish packaging budget into the Ecoembes or other SCRAP fee, the plastic tax and a deposit cash-flow reserve, and price your own pack mix at the 2027 Ecoembes rates already published.
- Procurement, by the next supplier review: ask every Spanish converter and every EU supplier for the non-recycled plastic weight per component and for the accredited recycled-content certificate for each lot, and confirm how the tax appears on invoices.
- Tax and compliance teams, now: map each legal entity to one of the four supply routes in Exhibit 6, confirm registration and CIP codes where you import or acquire within the EU, and keep prior declarations for any exempt medical sales. Check with counsel where a structure is unclear.
- Packaging development, before 2027 briefs are frozen: target recycled content above the Ecoembes thresholds (above 25% for PET, above 20% for HDPE and film), and remove the triggers for the 10% malus on trays and bottles.
- EPR managers, by 31 December 2026: use the open registry window to correct packaging categories and SCRAP details, then prepare the 2026 declaration due by 31 March 2027.
- Commercial and supply chain leads, by 1 January 2027: plan reusable beverage references for small-format shops and count each reusable unit as plastic removed from the tax base.
- Boards, at the next budget review: treat the deposit as an event with no confirmed date; ask for a plan that works whether the system starts in late 2026 or, as press reports suggest, in 2028 or later.
Questions for your board
- How much did we pay in Spain in 2026 in scheme fees and in plastic tax, and which supply route carried each euro?
- What share of the plastic we place in Spain is covered by an accredited recycled-content certificate, and who holds those files?
- Which of our Spanish packs sit just at a bonus threshold, such as exactly 25% recycled PET, where a small change earns the bonus?
- If certificates were rejected on one supplier’s lots, what would that add to our tax bill?
- What is our plan for deposit cash flow and labelling if the system starts at short notice?
- Do our non-Spanish entities that sell direct to Spanish consumers have an authorised representative under PPWR article 44.2?
What to watch
- 22 Nov 2026: the date press reports give for the Spanish deposit start; SPI has not yet confirmed it in any official act, and press reports of 11 October 2026 say no operator has been designated.
- 31 Dec 2026: the ordinary window to change packaging categories and SCRAP details in the producer register closes (PR-ES-002).
- 1 Jan 2027: Ecoembes 2027 rates apply, and food shops under 300 m2 must start offering reusable beverage references (PR-ES-002).
- 31 Mar 2027: closing date for 2026 packaging data to the producer register, whose window opens on 2 January 2027.
- 2027 to 2029: PPWR labelling provisions under article 12 start to apply, replacing the decree’s marking rules (PR-EU-001; PR-EU-003).
- 1 Jan 2028: last day for a Member State to notify an Article 50(5) exemption from compulsory deposit systems, and the proposed start of the EUR 1 per kg plastic own resource (PR-EU-007; PR-EU-018).
Methodology
- Data used: SPI rule notes PR-ES-001 and PR-ES-002, the SPI Spain jurisdiction and fee-market notes (14 October 2026), the Ecoembes 2026 and 2027 rows in the SPI EPR & Plastic Tax Calculator, which holds 216 rate rows in 14 markets, and official pages of the BOE, MITECO and the Agencia Tributaria consulted on 21 October 2026.
- Basket: an SPI assumption of 180 tonnes of household packaging (Exhibit 2), not a market average; glass at 300 g per jar for the unit factor; bottle weights for the deposit illustration at 25 g.
- Counting rules: rates as published, excluding VAT; per-kg rates x1,000 for per-tonne figures; eco-modulation only where a scenario names it; tax on non-recycled kilograms only, with recycled plastic counted only where a certificate is assumed. EUR only, with no currency conversion.
- Deposit date: checked against the MITECO 2023 bottle report, the MITECO note of 19 May 2026 and the decree; the 22 November 2026 date appears in SPI’s news log and in press reports, not in an official act SPI has read.
- Cut-off: 21 October 2026.
- Limitations: Ecoembes PDF headings are images, so lines are matched by position; the basket assumes the full tax reaches the brand; reuse and deposit administration costs are not priced; commercial and industrial packaging are left out. This is business analysis, not legal or tax advice; check with counsel.
FAQ
How is Spain's plastic packaging tax calculated?
The base is the kilograms of non-recycled plastic in non-reusable packaging, and the rate is EUR 0.45 per kilogram (Ley 7/2022, article 77; Agencia Tributaria). A tray of 20 g of virgin plastic owes EUR 0.009; one million of them owe EUR 9,000.
Does the plastic tax replace the Ecoembes fee?
No. The tax goes to the Agencia Tributaria and the EPR fee goes to the producer’s SCRAP, such as Ecoembes, for the same packaging. On SPI’s 180-tonne basket the fee is EUR 46,627.50 and the tax EUR 29,250.00 in 2026.
How does recycled plastic reduce the Spanish tax?
Recycled plastic leaves the tax base only if an accredited entity certifies it. Since the 12-month transition after 1 January 2023 ended, a manufacturer’s own declaration no longer suffices. False or incorrect certification is fined at 50% of the unpaid tax, minimum EUR 1,000.
Does Real Decreto 1055/2022 still apply after the PPWR?
Yes, in part. MITECO’s note of 19 May 2026 says the decree keeps applying to matters the PPWR does not regulate or does not contradict, until a new packaging decree MITECO is drafting enters into force.
When does Spain's deposit return system start?
SPI has not yet confirmed a start date in any official act. Press reports give 22 November 2026, two years after MITECO’s November 2024 bottle report, but press reports of 11 October 2026 say no operator has been authorised.
Who must register for the Spanish plastic tax?
Manufacturers in Spain register each establishment and file form 592. Intra-EU acquirers register once non-recycled plastic passes 5 kg in a month. Importers from outside the EU do not register; customs settles the tax on the import declaration.
