In France, Citeo's eco-modulation adds 30% to one brand basket while the Triman label is being written out of the law
By 2027 a brand owner selling household packaging in France must reach a 10% reuse share, keep printing Triman and Info-tri until French law or an EU label replaces them, keep “recyclable” wording inside the 2022 decree, and design out the formats that carry Citeo’s 25% to 100% maluses, which add EUR 16,815.43 (30.5%) to the four-product basket Strategic Packaging Insights (SPI) priced.

The basket uplift is an SPI calculation on an SPI basket and does not update. The reuse figure applies to every turnover tier in 2027.
The AGEC law of 10 February 2020 gave France a long list of national packaging rules, and since 12 August 2026 the EU Packaging and Packaging Waste Regulation (PPWR) has applied on top of it. Some of those French rules are tightening, some have been struck down in court, and the most familiar, the Triman sorting logo, is under a Commission court case and a bill that would replace it.
Executive summary
France layers national packaging rules on top of EU law, and October 2026 is an awkward moment to plan for them. The AGEC law built five pillars: a 2040 exit from single-use plastic packaging, a reuse quota, a sorting label, rules on environmental wording and a list of format bans. Each now sits next to an EU rule that covers the same ground, and three of them are moving.
The sorting label is the clearest case. On 17 July 2025 the European Commission referred France to the Court of Justice over Triman and Info-tri, calling them obstacles to free movement of goods. A government bill adopted by the Senate on 18 February 2026 would replace Triman with the EU harmonised label, but the Assemblée nationale has not yet voted on it, and the EU label under PPWR Article 12 cannot apply before 12 August 2028. Until one of those changes takes effect, the French decree of 29 June 2021 still requires Triman and Info-tri on household packaging.
The fruit and vegetable rule has the opposite problem: the ban stands in the law, but the Conseil d’État annulled both decrees that set its exemption list, in December 2022 and November 2024. The single-use plastic targets have a different gap. The first 3R decree expired on 31 December 2025, the government’s own interim review found plastic packaging had grown, not fallen, and SPI has not yet confirmed a second decree for 2026 to 2030.
The rule with the most money attached is the one least likely to move: Citeo’s eco-modulated fee. On a four-product basket of 1 million units each, Citeo’s 2026 maluses and bonuses raise the bill from EUR 55,219.40 to EUR 72,034.83 (Exhibit 1). A single black plastic tray accounts for EUR 14,146.70 of the EUR 16,815.43 increase.
For leaders, the order of work follows from that. Fix the formats that carry maluses before the 2027 declaration, because the saving is certain and immediate. Build the 2027 reuse plan, because the 10% threshold arrives on 1 January. Keep Triman artwork stable but modular, so the switch to an EU label is a plate change rather than a redesign. And audit every “recyclable” statement against the 2022 decree and the EU green claims rules that have applied since 27 September 2026.
Key findings
- SPI calculation: Citeo’s 2026 eco-modulation raises the SPI basket from EUR 55,219.40 to EUR 72,034.83, or 30.5%, and the 100% malus on one non-detectable black PP tray is 84.1% of that increase (Citeo Guide du tarif 2026).
- Citeo reports EUR 33.5 million of packaging bonuses and EUR 19.7 million of maluses in its 2025 accounts, against EUR 1,402 million of packaging contributions (EUR 1,460 million including graphic papers); SPI calculation: packaging maluses were about 1.4% of packaging contributions, so the fee lever is concentrated on a minority of packs (Citeo Rapport d’activité 2025).
- Producers with turnover above EUR 50 million needed 8% reused packaging in 2026, and every tier needs 10% in 2027, against a national reuse share of 2.2% in 2023 (Décret n° 2022-507; 3R interim review, June 2025, per PR-FR-001).
- The European Commission referred France to the Court of Justice over Triman and Info-tri on 17 July 2025; the Senate’s European affairs committee wrote on 21 January 2026 that France will remain in breach until the EU harmonised label is in place.
- The Conseil d’État annulled the produce decree n° 2021-1318 on 9 December 2022 and its successor n° 2023-478 on 8 November 2024, so the produce ban has had no valid exemption list for most of its life.
- “Recyclable” wording in France has a legal floor: “majoritairement recyclable” only when five criteria are met and recycled output exceeds 50% of the collected mass, and “biodégradable” has been banned on packaging since 1 January 2023 (Décret n° 2022-748; ministry FAQ, November 2025).
- From 1 January 2026, Citeo pays a prime of EUR 450 to EUR 550 per tonne of recycled plastic incorporated, rising to EUR 1,000 per tonne for hard-to-recycle resins from 2028 (arrêté of 5 September 2025).
The AGEC rulebook in October 2026
The AGEC law, n° 2020-105 of 10 February 2020, works through articles of the Code de l’environnement, and each article needs a decree to bite. That structure is why French packaging rules can be in force on paper and empty in practice, as the fruit and vegetable case shows. The SPI Regulation Tracker holds three French rules among its 79: PR-FR-001 for the 3R framework, PR-FR-002 for the dated bans and PR-FR-003 for Triman and Info-tri. Exhibit 2 sets each AGEC pillar against its implementing text and its status on 20 October 2026.

Two changes since 2024 rewrote parts of this map. The law of 30 April 2025 adapting French law to EU law removed article 23 of the Climate and Resilience law and moved the recyclability obligation for styrenic packaging from 2025 to 2030, according to Citeo’s polystyrene roadmap, dated September 2025. And the 2026 adaptation bill, filed in the Senate on 10 November 2025 under the accelerated procedure, carries the next round, including the Triman replacement in its article 48 (Sénat dossier pjl25-118).
SPI analysis
The pattern is that France legislated before the EU, the EU then legislated over the same ground, and France is now unwinding the parts that conflict. A brand owner should treat any French packaging rule with no EU counterpart as durable only where an EU text expressly allows national measures, as the PPWR does for waste prevention beyond its minimum targets.
Ten years of dates, 2020 to 2030
Exhibit 3 places the AGEC decrees, the court rulings, the EU rules and the Citeo fee cycle on one line. Most of the business deadlines cluster in two windows: 2026 to 2027, when the reuse quota and the fee changes bite, and 2028 to 2030, when the EU label and the PPWR design rules arrive.

Single-use plastic: the 3R targets and the 2040 goal
Article L. 541-10-17, created by article 7 of the AGEC law, sets the goal of ending single-use plastic packaging on the French market by 2040 and requires five-year decrees on the way (PR-FR-001). The first, Décret n° 2021-517 of 29 April 2021, set three objectives for 31 December 2025: a 20% cut in single-use plastic packaging measured against 2018 tonnage, “dont au moins 50 % obtenus par recours au réemploi et à la réutilisation d’emballages”; a move towards eliminating 100% of unnecessary packaging, defined as packaging with no essential technical function; and a recycling channel for all such packaging by 1 January 2025 (AIDA text). Since 1 January 2023 a second indicator also counts sales units.
| Objective in Décret n° 2021-517 | Target and date | Latest official reading | Reading date |
|---|---|---|---|
| Reduce single-use plastic packaging against 2018 | 20% by 31 Dec 2025 | Up 3.3% between 2018 and 2021 | June 2025 review |
| Share of the cut delivered by reuse | At least half | National reuse share 2.2% in 2023 | June 2025 review |
| Unnecessary single-use plastic packaging | Tend to 100% removal by 31 Dec 2025 | About 139 cases handled by the reporting system | June 2025 review |
| Operational recycling channel | Tend to 100% by 1 Jan 2025 | About 19% without a channel, per federations | June 2025 review |
| Plastic packaging recycling rate | No figure in the decree | 25.2% in 2022; Eurostat 25.7% in 2023 | June 2025; May 2026 |
Source: AIDA (INERIS): Décret n° 2021-517; Ministry of Ecological Transition, Stratégie 3R interim review (June 2025), as recorded in SPI rule note PR-FR-001; Eurostat env_waspac 2023 via SPI France note, checked 30 Oct 2026.
The interim review covers data to 2022 and 2023, not the final 2025 result. SPI has not yet confirmed ADEME's final assessment.
The decree itself sets no penalty on companies. Its pressure arrives through article 5, which tells eco-organisms to reflect the objectives in their fee modulation, and through the dated bans (PR-FR-001). That is why Citeo’s 25% malus on small drink formats and on plastic grouping wraps, both raised from 10% in 2025, matters more to a brand’s budget than the target itself (Citeo guide 2026).
The 2040 goal survived a direct attempt to remove it. During the Senate debate on the 2026 adaptation bill, amendment 173 rect. quater proposed deleting the first paragraph of L. 541-10-17 on the ground that it conflicts with the PPWR; the committee and the government both opposed it and it was rejected (Sénat, amendment of 17 February 2026).
SPI analysis
A brand owner should plan as if the 2040 goal stands and a second 3R decree will arrive, because the fee lever keeps working without one. The practical test is the units indicator: a product range that grows in units while each pack gets lighter can still count against France’s reduction measure, which the interim review saw in household packaging, where units fell 2.8% between 2021 and 2023 while tonnage rose by 60,000 tonnes (PR-FR-001).
Reuse: the 10% threshold in 2027
Décret n° 2022-507 of 8 April 2022 is the only AGEC rule that sets a hard percentage on each producer. It applies to any producer placing at least 10,000 units of packaged products on the market a year, and it can be met individually, collectively or through an eco-organism (article R. 541-351). The share is counted per packaging unit, primary, secondary or tertiary, or by an equivalent capacity of 0.5 litre or 0.5 kg where the producer can justify it (article R. 541-350).
| Turnover tier | 2023 | 2024 | 2025 | 2026 | 2027 |

Tiers by the producer's annual turnover. A dash means no threshold applies in that year for that tier. Exemptions cover products where reuse is barred for hygiene or safety, or by the market authorisation.
The gap is wide. Reuse reached 2.2% of packaging in 2023, the first year reporting was compulsory, and the June 2025 review warned the figure may be incomplete (PR-FR-001). Citeo now collects the data: its 2026 guide puts reuse reporting, splitting packaging into reusable, reused and single-use, in March 2027 for 2026 placements (SPI fee-market note, France). The scheme reports EUR 35.1 million committed to reuse calls for projects in 2025 and EUR 175 million since 2023 for reuse and collection support (Citeo Rapport d’activité 2025).
The decree’s sanction articles cover other AGEC duties, such as free bottles and reusable tableware, and SPI has not yet confirmed a penalty specific to missing the D. 541-352 share. The cost of a shortfall is therefore indirect: no bonus, a weaker position with retailers and, from 2030, the PPWR’s own reuse targets for transport and grouped packaging, which attach to formats rather than to a national share (PR-FR-001 interactions).
SPI analysis
For most brands the cheapest reuse volume sits in transport packaging, such as pallets, crates and returnable trays, which counts as a packaging unit under R. 541-350 and is also where the PPWR’s 2030 targets bite. France’s professional packaging stream, whose specifications took effect on 1 January 2026, already requires its eco-organisms to put at least 5% of contributions into reuse (SPI France note).
Triman and Info-tri: required today, contested at EU level
Article L. 541-9-3 requires products under extended producer responsibility to carry a sorting sign and an instruction on how to sort or return them, and Décret n° 2021-835 of 29 June 2021 puts that into effect (PR-FR-003). For household packaging the eco-organism drafts the instruction, the producer prints it, and new versions must be applied within 12 months of their validity date, with any sell-off period capped at six months.

Fine amounts are as stated by the textile eco-organism Refashion citing article L. 541-9-4; SPI has not yet confirmed them against the statutory text. Not legal advice.
The Commission’s case has two limbs. National labelling rules for goods lawfully sold elsewhere in the EU are measures of equivalent effect to a quantitative restriction under Article 34 TFEU, and France did not notify the measure at the draft stage as Directive (EU) 2015/1535 requires (IP/25/1834). SPI has not yet confirmed a case number or a hearing date at the Court of Justice.
France’s response is the 2026 adaptation bill. The Senate’s European affairs committee reported on 21 January 2026 that article 48 would have the Triman scheme “soit remplacé par le dispositif harmonisé européen”, but also that this does not cure the breach in the meantime. The Senate adopted the bill on 18 February 2026 and sent it to the Assemblée nationale on 20 February, where the economic affairs committee was seized; the Assemblée’s dossier shows no vote by 20 October 2026.
The EU side is not ready either. The PPWR’s harmonised material label can apply from 12 August 2028 at the earliest, and Packaging Europe reported on 20 August 2026 that the Commission had missed its own target date for the labelling implementing act. The PPWR after August 2026 piece notes that the Commission’s guidance treats the EU labelling system as exhaustive outside deposit packaging, so a national mark printed next to the EU label would itself raise a question.
SPI analysis
Brand owners face a two-step artwork change with an unknown middle. Until the French law changes, Triman and Info-tri stay; once the EU act is adopted, its label follows within the PPWR timetable. The low-cost response is modular artwork: keep the Info-tri block in one fixed panel that can be swapped without touching the rest of the pack, and stop adding French-only marks to new multi-market packs unless the decree requires them.
"Recyclable" and other environmental wording
Article L. 541-9-1, from article 13 of the AGEC law, requires producers to publish the environmental characteristics of their products, and Décret n° 2022-748 of 29 April 2022 sets the wording (AIDA). The information sits on a free digital product sheet, available at purchase, and the ministry’s FAQ says a non-selectable PDF does not comply. The duty phased in by size: turnover of EUR 50 million and 25,000 units from 1 January 2023, EUR 20 million and 10,000 units from 2024 and EUR 10 million and 10,000 units from 2025, with both tests cumulative (ministry FAQ, November 2025).

Wording as set in the decree. AIDA lists the decree as in force with no amending text. The 2026 adaptation bill would rewrite the fourth paragraph of L. 541-9-1 from 27 September 2026; SPI has not yet confirmed its final wording. Not legal advice.
The five recyclability criteria are efficient collection across the territory, sorting, the absence of substances that disrupt recycling, recycled output above the mass threshold and recycling at industrial scale with sufficient quality and outlets (R. 541-221). The criteria line up closely with Citeo’s maluses: a pack that triggers a “perturbateur” malus, such as a carbon-black tray or a PETg sleeve on a PET bottle, will struggle to meet the third criterion, so the fee signal and the wording rule point the same way.
On 27 September 2026 the EU’s green claims directive began to apply, after a transposition deadline of 27 March 2026 (Directive (EU) 2024/825, Article 4(1)). The French 2026 adaptation bill, as filed, would rewrite the fourth paragraph of L. 541-9-1 with effect from that date, keeping the ban on “biodégradable” and “respectueux de l’environnement” (article 21 of bill n° 118). SPI has not yet confirmed how France has transposed the directive while the bill is pending.
A note on the record: SPI’s PPWR 2030 format restrictions piece reports that the Conseil d’État annulled Décret n° 2023-478 on 8 November 2024. That decree is the fresh produce exemption list, covered in the next section, not the claims decree. AIDA lists Décret n° 2022-748 on environmental wording as in force with no amending text.
SPI analysis
“recyclable” in France is a regulated term with a threshold, not marketing copy. A brand that sells the same pack in several EU markets should write one claim set that passes the French mass thresholds, the EU proof test and, from 2030, the PPWR recyclability grades, and drop any wording that only one of them allows.
Fruit and vegetables: a ban without a list
Since 1 January 2022, article L. 541-15-10 III has required retailers to sell whole fresh fruit and vegetables without plastic packaging, with exemptions for lots of 1.5 kg or more and for produce at risk of deterioration in bulk (PR-FR-002). The law left the list of exempt produce to a decree, and that list has twice been struck down (Exhibit 8).

| 2024-11-08 | Conseil d'État annuls Décret n° 2023-478 | Adopted before the EU standstill period had run out |
| 2025-11-10 | Adaptation bill filed; article 48 would remove the display duty | Pending at the Assemblée nationale |
| 2030-01-01 | PPWR restricts single-use plastic packs for produce under 1.5 kg | EU rule, with national exemptions |

SPI has not yet confirmed which implementing text, if any, applies to the French produce rule today. PPWR Annex V entry 2 applies from 1 January 2030.
The first ruling turned on the scope of the list. The law let the government exempt only produce at risk of deterioration in bulk, and the decree had included produce that did not necessarily present that risk (Conseil d’État press release, 9 December 2022). The court added, at point 8 of the decision, that the annulment made the ban in the sixteenth paragraph of L. 541-15-10 III inapplicable, without manifestly excessive consequences, so it did not delay the annulment’s effect. The applicants included the trade bodies Plastalliance, Polyvia, Felcoop and the fresh produce interprofession.
The second ruling, brought by Plastalliance and Elipso, was procedural: the Commission had told France the draft concerned a matter covered by the proposed PPWR, which required adoption to be postponed until 15 December 2023, and France adopted the decree on 20 June 2023 (PPWR 2030 format restrictions piece). The 2026 bill would end the national duty altogether, according to the Senate’s European affairs committee, leaving the field to Annex V of the PPWR from 2030.
SPI analysis
For a produce packer the French rule is now less binding than the EU rule that replaces it. Plan to the PPWR entry for 2030, keep evidence of the exemption grounds it allows, such as water loss, physical shocks and oxidation, and watch the Assemblée vote on article 48 before removing any plastic-free display commitments agreed with French retailers.
Citeo 2026: what eco-modulation does to a bill
Citeo and Léko are the approved eco-organisms for household packaging and graphic paper until 31 December 2029 (SPI France note). Citeo’s 2026 fee has three parts per sales unit (UVC): a weight part priced per material, a per-unit litter contribution by sector and a per-unit reuse contribution, and the bonuses and maluses then apply as a percentage of that unit’s total (Citeo guide 2026). Exhibit 9 summarises the 2026 modulation grid.
| Lever | Criterion | 2026 effect |
|---|---|---|
| Malus 100% | Rigid PET with aluminium, PVC or silicone; dark rigid plastics not detectable by optical sorting; non-soda-lime glass; glass with porcelain or ceramic element or non-magnetic steel closure | Doubles the unit's contribution |
| Malus 50% | PE or PP rigid with density above 1; PET bottles with PETg, PLA or unperforated PS sleeves; PET with other dense rigid plastic | Raised from 10% in 2025 |
| Malus 25% | Drink formats of 0.5 litres or less; plastic promotional or grouping wraps | Raised from 10% in 2025 |
| Malus 10% | Paper and board metallised on all faces | Unchanged |
| Bonus, weight reduction | At least 1% lighter than the previous year, same material family | Equal to the cut, rounded up |
| Bonus, refill | Refill at least 33% lighter for the same quantity | Proportional, on the refill only |
| Recycled fibre | Paper and board above 50% recycled fibre | 10% off the paper weight part |
| Prime, recycled plastic | Recycled plastic incorporated | EUR 450 or EUR 550 per tonne; EUR 1,000 for hard-to-recycle resins from 2028 |
Source: Citeo, Guide du tarif des emballages ménagers 2026 (updated 22 June 2026); AIDA (INERIS) arrêté of, checked 30 Oct 2026.
Maluses apply to the unit's total contribution (weight, litter and reuse parts). Malus levels stack across levels but not within one level, except the two 25% maluses. A unit with a recycling-disruptor malus can take no bonus. Percentages for the reuse and awareness bonuses are not stated legibly in the guide and are left out.
Five maluses were removed for 2026, including those on PET bottles with glass marbles, mineral oils and opaque rigid PET, and PVC is now charged through the tariff itself at 210.01 euro cents per kg (Citeo guide 2026). Timing matters for the reduction bonus: a lighter pack introduced before 1 April 2026 counts for the full year, one introduced between 1 April and 30 September needs two declaration lines, and a change after 30 September counts only from 2027.
The recycled plastic prime comes from a ministerial arrêté of 5 September 2025, published on 7 September and in force on 1 January 2026. It pays EUR 450 per tonne of recycled plastic from another EPR stream and EUR 550 per tonne from the same stream; for hard-to-recycle resins in contact-sensitive packaging, including PP, HDPE, LDPE, coloured and opaque PET and non-expanded polystyrene, it pays EUR 1,000 per tonne, with a derogation at EUR 550 for 2026 and 2027 (AIDA). The prime can be combined with the reduction, grouping and small-format maluses, but not with a disruptor malus (Citeo guide 2026).
To show the effect, SPI priced a basket of four household products of 1 million units each through the 2026 tariff (Exhibit 10). The weights are SPI assumptions, chosen so that each product meets one modulation line, and readers should replace them with their own in the SPI EPR & Plastic Tax Calculator.
| Product and pack | Weight part | Per-unit parts | Before eco-modulation | Modulation applied | After eco-modulation |
|---|---|---|---|---|---|
| 50 cl drink: 20 g clear PET bottle, 2 g PE cap | 15540.2 | 1573 | 17113.2 | 25% small-format malus | 21391.5 |
| Sauce: 300 g glass jar, 12 g steel lid, 2 g recycled-fibre paper label | 7325 | 1055 | 8380 | 10% off the label's paper weight part | 8328.38 |
| Ready meal: 15 g carbon-black PP tray, 2 g PE film | 13091.7 | 1055 | 14146.7 | 100% malus, not detectable by optical sorting | 28293.4 |
| Cereal: 40 g board box, 5 g PP liner, 10% lighter than last year | 14524.5 | 1055 | 15579.5 | 10% weight reduction bonus | 14021.55 |
| Basket total | 50481.4 | 4738 | 55219.4 | no data | 72034.83 |

EUR, excl. VAT. 1,000,000 UVC per product, 398 tonnes in all. Weight rates in euro cents per kg: clear PET bottle 70.00; PE and PP rigid 77.01; PP flexible 84.01; paper and board 25.81; glass 2.01; steel 6.49. Per-unit parts: litter 0.1433 cents (drinks) or 0.0915 cents (food), reuse 0.0140 cents. Citeo also publishes a per-unit litter grid by number of packaging elements; this calculation uses the per-sector values, so it is indicative.
SPI calculation: for the drink, 20,000 kg x EUR 0.70 + 2,000 kg x EUR 0.7701 = EUR 15,540.20, plus EUR 1,433.00 litter and EUR 140.00 reuse, gives EUR 17,113.20, and the 25% malus adds EUR 4,278.30. For the tray, 17,000 kg at EUR 0.7701 is EUR 13,091.70, the per-unit parts add EUR 1,055.00, and the 100% malus doubles EUR 14,146.70 to EUR 28,293.40. The bonuses are smaller: EUR 1,557.95 on the cereal box and EUR 51.62 on the jar label.
Three points stand out. First, weight is a poor guide to the fee: the jar is 314 of the basket’s 398 tonnes but 11.6% of the fee after modulation, while the tray is 17 tonnes and 39.3%. Second, the per-unit parts are 8.6% of the unmodulated bill, so very light packs sold in high volume pay a fee that weight cuts cannot reach. Third, maluses are multiplied by the whole unit contribution, so the 100% malus on a 17 g tray costs EUR 0.0141 per unit, more than the entire unmodulated fee on the glass jar at EUR 0.0084.
In practice: Citeo.
Citeo’s 2025 activity report records EUR 1,460 million of total contributions in its 2025 accounts, of which EUR 1,402 million came from packaging (EUR 1,119 million by weight and EUR 283 million per unit), on 5,306 thousand tonnes of household packaging, 131,148 client companies at 31 December 2025 and a 73% household packaging recycling rate, up 9 points since 2020. The same accounts show EUR 33.5 million of packaging bonuses and EUR 19.7 million of maluses. SPI calculation: packaging maluses were about 1.4% of packaging contributions, so across the market eco-modulation is a small share of the bill, and a basket built around penalised formats, as in Exhibit 10, is where it decides the cost.
Scenarios: three versions of the same basket
Exhibit 11 runs the basket through a redesign case and a downside case. Both use only Citeo’s published 2026 rules and the September 2025 arrêté; the redesign case needs one stated assumption on the recycled plastic prime.
| Case | Assumptions | Basket fee (EUR) | Change against unmodulated (%) |
|---|---|---|---|
| Unmodulated | 2026 weight and per-unit parts only | 55219.4 | 0 |
| Low, redesigned | Detectable tray, 50% rPET bottle with prime, bonuses kept | 55138.13 | -0.1 |
| Base | Exhibit 10 as priced | 72034.83 | 30.5 |
| High | PETg sleeve on the bottle, 75% combined malus; no weight bonus | 84599.56 | 53.2 |
Source: SPI calculation from Citeo, Guide du tarif 2026, and AIDA (INERIS) arrêté of, checked 30 Oct 2026.
EUR only, excl. VAT. Low: the tray moves to a detectable natural PP grade (no malus); the drink bottle uses 50% recycled PET (10 tonnes) and earns EUR 550 per tonne on the 5 tonnes above a 25% threshold, an SPI assumption from the consultation draft; on all 10 tonnes the low case is EUR 52,388.13. High: a 1 g PETg sleeve priced at 140.01 cents per kg adds the 50% malus to the 25% one, and the cereal box loses its reduction bonus.
The swing from low to high is EUR 29,461.43 on the same four products and the same volumes, or 53.4% of the unmodulated bill. Most of it comes from two decisions a packaging team controls: the tray colour, worth EUR 14,146.70, and the sleeve, which takes the drink bottle from EUR 21,391.50 to EUR 32,398.28.
SPI calculation: in the high case the bottle’s unit total becomes EUR 18,513.30 with the sleeve weight, and the stacked 25% and 50% maluses multiply it by 1.75. Citeo’s guide says levels stack while two maluses at the same level do not, except the two 25% maluses (Citeo guide 2026).
The recycled plastic prime is the one uncertain input. The consultation draft of the arrêté set minimum recycled content thresholds for the EUR 450 and EUR 550 tiers, 25% for PET drink bottles until 2029, and SPI has not yet confirmed whether the published text pays on all incorporated tonnes or only those above the threshold. The range is EUR 2,750 to EUR 5,500 on the bottle.
SPI has not yet confirmed Citeo’s 2027 tariff against Citeo’s own guide. A compliance adviser reports that Citeo and Léko published 2027 tariffs on 30 September 2026, revised on 8 October, with Citeo’s eco-modulation unchanged; if that holds, the shape of Exhibit 11 carries into the 2027 declaration.
A change map for brand owners
The French rules move at different speeds and carry different costs, so a single compliance plan treats them badly. SPI sorts the six pillars of Exhibit 2 on two tests: is the rule’s direction settled, and does waiting cost money now (Exhibit 12).
| Quadrant | Test | Rules | Move |
|---|---|---|---|
| Act now | Settled, waiting costs money | Citeo maluses and bonuses; reuse 10% in 2027; recycled plastic prime | Redesign penalised formats before the 2027 declaration; lock reuse volumes |
| Build in | Settled, waiting costs little | Recyclable wording rules; "biodégradable" ban; EU green claims test | Audit claims once and fix the claim library |
| Stay modular | Unsettled, waiting costs money | Triman and Info-tri, then the EU label | Keep the sorting block swappable; print to the decree until it changes |
| Watch | Unsettled, waiting costs little | Produce display duty; second 3R decree; 2040 goal | Plan to PPWR 2030; track the Assemblée vote and the Journal officiel |

Settled means the legal direction is fixed through 2027 on the texts SPI has read. Cost of waiting is the euro cost of a year's delay on current rules. A framework for planning, not legal advice.
SPI analysis
Most teams spend their French budget in the wrong quadrant. Artwork reviews for Triman absorb design time on a label that is likely to change, while the fee formats in the “act now” quadrant, which carry a cost every year they stay on shelf, wait for the next range review. The basket shows the order: the tray change alone is worth more than every artwork change in the plan.
In practice: Danone.
France, Danone’s headquarters country, gave 8% of its 2025 sales, and Danone was a founding member of Citeo in 1992 (SPI Buyers Database, Danone profile, citing the 2025 Universal Registration Document and company packaging pages). The company reports 1.39 million tonnes of packaging in 2025, 0.68 million tonnes of it plastic, and 87% of packaging designed for recycling measured against the PPWR definition, with a goal of 95% or more by 2030. Its evian and Volvic bottles use 100% recycled PET. SPI has not seen Danone’s French declaration, so the fee effect of Citeo’s small-format malus and the recycled plastic prime on its range is not estimated.
In practice: McDonald’s.
McDonald’s had 1,630 restaurants in France at the end of 2025, and France has required reusable tableware for meals eaten on site since 1 January 2023 in outlets serving at least 20 covers at once (SPI Buyers Database; PR-FR-002). The company reports that 96% of its primary guest packaging in Europe was fibre-based at the end of 2024. Its October 2025 report on reusable packaging in Europe, based on PwC UK analysis, modelled a 2030 PPWR scenario with 10% of takeaway in reusables and reported greenhouse gas emissions per restaurant up 61% and plastic packaging waste up 626%; the company argues for fibre packaging plus recycling over reuse mandates. For a French operator, the D. 541-352 share and the PPWR’s 2030 dine-in rule meet in the same restaurants.
Industry reaction
“harmonised rules in this respect should be detailed in future implementing acts”
The Commission ties that point to the PPWR, which is why it views national sorting labels as an obstacle until the EU act exists.
“la France demeurera en infraction tant que le dispositif harmonisé européen ne sera pas mis en place.”
Sénat, commission des affaires européennes, French upper house committee, rapport d’information n° 300 (2025-2026), 21 January 2026
“C’est pourquoi le Conseil d’État annule le décret du Gouvernement, qui devra redéfinir une liste par décret pour répondre à la mission que lui a confiée la loi.”
Conseil d’État, France’s highest administrative court, press release on plastic packaging for fruit and vegetables, 9 December 2022
“La France figure parmi les pays européens les moins performants en matière de recyclage des emballages ménagers”
In English: “France will remain in breach until the harmonised European scheme is in place.”
In English: “That is why the Conseil d’État annuls the Government’s decree, which will have to redefine a list by decree to fulfil the task the law gave it.”
In English: “France is among the worst-performing European countries for recycling household packaging”
The minister was answering a question on the government’s Plastic plan. On 4 September 2026 the government said no compulsory national deposit would be introduced and proposed a voluntary, territorial system for local authorities instead, a decision beverage producers called an incomprehensible step back (Banque des Territoires, 4 September 2026). Under PPWR Article 50, a deposit becomes mandatory unless France separately collects 80% of covered bottles and cans placed on the market in 2026 and notifies an exemption plan by 1 January 2028 (SPI France note).
What leaders should do now
- Packaging development leads, by 31 December 2026: list every French SKU that carries a 100% or 50% Citeo malus, starting with dark rigid plastics and sleeved PET, and schedule a detectable or unsleeved version, because a change after 30 September 2026 earns its bonus only from the 2027 declaration.
- Finance and EPR managers, by the end of February 2027: declare 2026 placements with the reduction bonus and recycled-fibre discount evidence ready, and price 2027 in the SPI EPR & Plastic Tax Calculator with and without modulation.
- Supply chain and sustainability leads, by 1 January 2027: confirm the 10% reused packaging share in your turnover tier, with transport packaging counted, and prepare the March 2027 reuse report Citeo requests.
- Procurement, before 2027 contracts are signed: ask resin suppliers for recycled content documentation that supports the EUR 450 to EUR 1,000 per tonne prime, and plan for the hard-to-recycle resin rate reaching EUR 1,000 in 2028.
- Brand and artwork teams, now and at each print run: keep Triman and Info-tri as required by Décret n° 2021-835, in a fixed, swappable panel, and track the Assemblée nationale vote on article 48 and the Commission’s labelling implementing act.
- Marketing and legal teams, now: audit every “recyclable”, “recycled” and green claim against the 2022 decree thresholds and the EU proof test applying since 27 September 2026, and check with counsel where a claim is borderline.
- Fresh produce packers and retailers, by 2028: plan to the PPWR 2030 restriction for produce under 1.5 kg, and keep evidence of the exemption grounds it allows while the French display duty is unsettled.
Questions for your board
- What did we pay Citeo for 2025 placements, and what share came from maluses and bonuses?
- Which of our French SKUs carry a 100% or 50% malus, and what would the redesign cost against the annual fee it saves?
- What share of our French packaging was reused in 2026, and how do we reach 10% in 2027?
- Is any of our French on-pack wording outside the “majoritairement recyclable” or “entièrement recyclable” thresholds?
- How quickly can our artwork move from Triman to an EU label once the implementing act is adopted?
- Do we have exposure to a French beverage deposit if the PPWR Article 50 test is failed?
What to watch
- Nov 2026: Citeo opens the online declaration space for 2026 placements.
- 28 Feb 2027: the January to February window for declaring 2026 placements to Citeo closes.
- 2027: the Assemblée nationale vote on the 2026 adaptation bill, including article 48 on Triman, produce and bags; SPI has not yet confirmed a date.
- 1 Jan 2027: the 10% reused packaging share applies to every turnover tier (Décret n° 2022-507).
- 1 Jan 2028: deadline for an Article 50(5) deposit exemption notification, and the EUR 1,000 per tonne prime for hard-to-recycle resins (PR-EU-007; arrêté of 5 September 2025).
- 12 Aug 2028: earliest date for the EU harmonised label under PPWR Article 12 (PR-EU-003).
- 1 Jan 2030: PPWR Annex V restrictions, including produce packs under 1.5 kg, and the deferred French recyclability duty for styrenic packaging.
Methodology
- Data used: the SPI Regulation Tracker rules PR-FR-001, PR-FR-002 and PR-FR-003 with their rule notes, the SPI France jurisdiction and fee-market notes, the Citeo rows in the SPI EPR & Plastic Tax Calculator (216 rows in 14 markets), decree texts on AIDA, the database run by INERIS for the Ministry of Ecological Transition, Conseil d’État decisions, Senate and Assemblée nationale records, EUR-Lex and Citeo’s own guides and reports.
- Counting rules: Citeo rates as published, excluding VAT; euro cents per kg divided by 100 for EUR per kg; maluses and bonuses applied to each unit’s total contribution as the 2026 guide describes; EUR only.
- Basket: four products of 1,000,000 UVC each, with pack weights chosen by SPI to meet one modulation line each. It is a device to show the mechanism, not a market average.
- Scenarios: low and high cases change only the stated pack features; the recycled plastic prime in the low case assumes payment above a 25% threshold, with the all-tonnes figure in the note.
- Cut-off: 20 October 2026.
- Differences from SPI data: PR-FR-002 lists the removal of non-recyclable styrenic packaging from 2025; Citeo’s polystyrene roadmap of September 2025 reports that article 37 of the law of 30 April 2025 moved that duty to 2030, and this piece uses the later position.
- Limitations: the per-unit litter grid has two forms in the guide; Citeo’s 2027 tariff and the final recycled plastic thresholds are not yet confirmed by SPI; the produce and Triman positions depend on a bill still before Parliament. Confirm obligations with Citeo or Léko and check with counsel where it applies.
FAQ
Is the Triman logo still mandatory in France?
Yes, as of 20 October 2026. Décret n° 2021-835 requires Triman and Info-tri on household packaging, with exceptions for glass drink containers and very small packs. A bill adopted by the Senate in February 2026 would replace it with the EU label, but the Assemblée nationale has not yet voted.
When will the EU label replace Triman?
The PPWR’s harmonised label can apply from 12 August 2028 at the earliest, once the Commission adopts its implementing act. The Commission had not adopted it by August 2026. The European Commission referred France to the Court of Justice over Triman on 17 July 2025.
What reuse share must French producers reach in 2027?
Ten per cent of packaging placed on the market must be reused in 2027, for every turnover tier, under Décret n° 2022-507. In 2026 the share was 8% above EUR 50 million of turnover, 7% between EUR 20 and 50 million, and 5% below EUR 20 million.
Can I write "recyclable" on packaging in France?
Only in the decree’s wording. “Majoritairement recyclable” requires five criteria, including recycled output above 50% of the collected mass, and “entièrement recyclable” requires above 95%. “Biodégradable” and “respectueux de l’environnement” have been banned since 1 January 2023.
How much does a Citeo malus cost?
Citeo’s 2026 maluses add 10%, 25%, 50% or 100% to a unit’s total contribution. In SPI’s basket, a 100% malus on a black plastic tray doubled its fee from EUR 14,146.70 to EUR 28,293.40 for 1 million units, and the basket rose 30.5% overall.
Is plastic packaging for fruit and vegetables banned in France?
The law still states the rule, but the Conseil d’État annulled both decrees listing exempt produce, in December 2022 and November 2024. A pending bill would remove the duty. From 2030 the PPWR restricts single-use plastic packs for produce under 1.5 kg across the EU.
