Germany's new packaging act is in force and its plastic levy is billed by the kilogram, while the plastic packaging tax is still only reported

The Verpackungsrecht-Durchführungsgesetz (VerpackDG) replaced the Verpackungsgesetz on 12 August 2026 and keeps LUCID registration, dual system participation and the 15 May declaration of completeness; the single-use plastic fund charges from EUR 0.001 to EUR 8.972 per kg under its 2023 ordinance; and the plastic packaging tax exists only as a reported draft, with no Bundestag or finance ministry text that SPI has found as of 24 October 2026.

German packaging compliance now runs on three confirmed layers: the EU PPWR, the national VerpackDG and the Einwegkunststofffonds levy. A fourth layer, a national tax on plastic packaging reported at EUR 550 per tonne from July 2027, stalled in mid-October and SPI has not yet confirmed it.

Executive summary

Germany did not wait for the PPWR to settle in before rewriting its own law. The Bundestag adopted the Act on 11 June 2026, the Bundesrat let it pass on 10 July 2026, and the Verpackungsrecht-Durchführungsgesetz of 13 July 2026 (BGBl. 2026 I Nr. 207) has applied since 12 August 2026, the same day as Regulation (EU) 2025/40 (gesetze-im-internet.de; Bundesregierung, 12 August 2026). So the “status in the legislative process” question has a short answer: the VerpackDG is law, and what is still moving is its follow-up.

The core duties a packaging buyer knew under the Verpackungsgesetz survive under new section numbers. Producers register in LUCID with the Zentrale Stelle Verpackungsregister (section 6), join a dual system for household packaging (section 7), report data (section 9) and, above 80 tonnes of glass, 50 tonnes of paper and board or 30 tonnes of other materials, file a declaration of completeness by 15 May (section 10). Section 45 keeps 25% recycled content for PET single-use drink bottles and sets 30% for all single-use plastic drink bottles from 1 January 2030, and section 60 keeps the duty to offer takeaway food and drinks in reusable packaging at no higher price.

The transitional clock matters more this autumn than the new sections. Section 68 ends old-law system participations by 31 December 2026, asks for changes to register data by 12 November 2026, and applies the second list of fines only from 12 February 2027 (Exhibit 3).

Alongside the Act sits the single-use plastic fund. Producers of nine product types pay per kilogram, from EUR 0.177 for food containers to EUR 8.972 for tobacco filters (Exhibit 7). The fund collected about EUR 216 million for 2024, according to the municipal utilities association VKU, well under the ordinance’s estimate of up to EUR 436 million, and the Umweltbundesamt (UBA) has moved its payout of about EUR 205 million to early 2027 after a calculation error.

The plastic packaging tax is the open question. Press reports describe EUR 550 per tonne of plastic from 1 July 2027, to be added to the Haushaltsbegleitgesetz 2027 by amendment; 33 associations and a customs union opposed it on 9 October 2026; and reports say the CDU/CSU group stopped a planned cabinet decision in mid-October. SPI has not found a Bundestag Drucksache or finance ministry text, so this piece treats the tax as reported only. For leaders the order of work is clear: fix 2027 system contracts and LUCID data now, budget the fund levy at published rates, and model the tax as a scenario, not a cost line.

Key findings

  1. The VerpackDG of 13 July 2026 (BGBl. 2026 I Nr. 207) has applied since 12 August 2026 and replaced the Verpackungsgesetz; the Bundestag adopted it on 11 June 2026 and the Bundesrat did not call the mediation committee on 10 July 2026 (gesetze-im-internet.de; Bundesrat Drucksache 377/26).
  2. Section 68 sets the near dates: changes to register data by 12 November 2026, old system participations ending no later than 31 December 2026, and producers of packaging outside system participation operating without section 19 approval until 31 December 2027 (gesetze-im-internet.de).
  3. Section 66(3) caps fines at EUR 200,000, EUR 100,000 or EUR 10,000 depending on the offence, and section 66(2) applies only from 12 February 2027.
  4. The single-use plastic levy runs from EUR 0.001 per kg for deposit-bearing drink containers to EUR 8.972 per kg for tobacco filters; cups pay EUR 1.236 and lightweight carrier bags EUR 3.801 (section 2 EWKFondsV, Drucksache 20/8128).
  5. The fund paid out nothing by 2 October 2026: the UBA withdrew its payout notices for about EUR 205 million and now plans payment in early 2027 (UBA press release 22/2026).
  6. A plastic packaging tax is reported at EUR 550 per tonne from 1 July 2027, but SPI has not yet confirmed any official text; the Bundestag finance committee has set a hearing on the tax measures of the Haushaltsbegleitgesetz 2027 for 9 November 2026, and SPI has not yet confirmed that the plastic tax is part of it (Bundestag, 12 October 2026).
  7. SPI calculation: on a 50-tonne takeaway basket, the reported tax would add EUR 27,500 a year at full year, against EUR 22,908 of confirmed levy (Exhibit 12).

Four layers, three of them law

A German packaging bill now has four possible layers, and they differ in who sets them, who collects the money and how certain they are. Exhibit 2 puts them side by side.

Status as of 24 October 2026. Dual system fees are agreed privately between producers and systems; no public tariff exists, so SPI shows none.

The layers stack rather than replace each other. A to-go cup sold in Germany needs a PPWR-conform design, a dual system contract if it ends up with households, and a fund levy payment; the SPI rule note for PR-DE-001 records that paying one does not discharge the other. If the reported tax comes, the same cup would carry a fourth charge on the weight of its plastic.

The household structures behind the second layer are large. Eurostat data in SPI’s Germany note show 215.19 kg of packaging waste per person in 2023, against an EU average of 177.8 kg, with 51.3% of German plastic packaging recycled against 41.7% for the EU. The Zentrale Stelle allocated 2025 market shares to ten dual systems, from BellandVision to ZENTEK, on annual reports filed on 1 June 2026. The Germany page of the SPI Regulation Tracker holds both national rules, PR-DE-001 and PR-DE-002.

SPI analysis

The four layers move on four different clocks. The PPWR clock is set in Brussels, the system clock in the VerpackDG transition, the fund clock in a UBA rate review due by the end of 2026, and the tax clock in a budget negotiation. A compliance plan that treats them as one German “packaging law” will miss at least one date.

The VerpackDG: from bill to law

The legislative path ran in four months. The federal government tabled its bill as Bundestag Drucksache 21/5346 on 15 April 2026, the Bundestag adopted it on 11 June 2026, the Bundesrat let it pass on 10 July 2026, and it was signed on 13 July 2026 (Exhibit 3). The Act’s own title is the Gesetz zur Durchführung der Verordnung (EU) 2025/40 betreffend Verpackungen, and the government bill says it legislates only where the PPWR requires national rules, mandates them or leaves Member States room (Drucksache 21/5346).

The Bundesrat’s consent came with a list of complaints. Its resolution regrets that the government and the Bundestag largely ignored its earlier amendments, asks for a prompt amending law, criticises the cap in section 42(2) on alternative recycling routes for plastics, chemical recycling in particular, and asks for quick ordinances on eco-modulated fees under section 26a (Bundesrat Drucksache 377/26 (Beschluss), 10 July 2026). SPI has not yet confirmed a date for that amending law.

The government framed the result as continuity with tighter targets. Its release on the day of entry into force lists an EU-harmonised sorting label, avoidance of hard-to-recycle plastics and substances such as PFAS, limits on oversized packaging, and a plastic recycling quota of 75% for the dual systems from 2028, while keeping existing German structures to limit bureaucracy (Bundesregierung, 12 August 2026). Der Grüne Punkt, one of the ten dual systems, reported after the Bundestag vote that the plastic quota rises to 80% from 2030 and that the environment committee added incentives for environmentally friendly design.

In practice: Der Grüne Punkt.

In its news of 18 June 2026 the system operator summarised the adopted law as cutting packaging waste, strengthening the circular economy and expanding the use of recycled material. It recorded the accompanying Bundestag resolution asking the government to set concrete specifications for recyclate use by 2027 and to push for a uniform EU procedure for proving plastic recyclate content. For a system, the 75% and 80% quotas set the sorting and recycling capacity it must contract; for a producer, they are the cost driver behind the next system price talks, which remain private.

Summary of the official text for planning, not legal advice. Check with counsel for your packaging.

LUCID registration. Section 6 obliges producers to register with the Zentrale Stelle Verpackungsregister, which under the VerpackDG is also the register authority for the PPWR. The Zentrale Stelle’s guidance says registration remains the producer’s own task with no exemption, and that a company whose name or brand appears on the packaging counts as both manufacturer and producer. Without a brand, the answer depends on the packaging type: sales and grouped packaging generally trigger duties once filled. A foreign company counts as producer only where it ships directly from abroad to a German end user.

The authorised representative. From 12 August 2026 a producer based abroad that sells to German end users without a German branch must appoint an authorised representative, which was voluntary before. The representative must be named at the initial LUCID registration, and producers already registered are prompted to add one when they log in (Zentrale Stelle). SPI’s rule note for PR-DE-001 also records the interaction with the EU Omnibus proposal on authorised representatives, which the PPWR after August 2026 piece follows.

System participation and data. Section 7 requires producers of household packaging to join one or more dual systems before making it available. Section 9 asks them to report registration number, material types and mass, the system and the period to the Zentrale Stelle without delay after reporting to the system; producers under 10 tonnes a year may report once, by 1 June of the following year. Section 68(1) is the clause to read this quarter: participations agreed under the old law before 12 August 2026 continue, unless agreed otherwise, but no longer than 31 December 2026.

The declaration of completeness. Section 10 keeps the thresholds of the old law (Exhibit 5).

Tonnes of packaging placed on the market in the previous calendar year. The Zentrale Stelle or the competent Land authority may also demand a declaration below the thresholds.

The Zentrale Stelle adds three points that change the workload for 2027. The check must be done by an auditor registered with it, a Sachverständiger, Wirtschaftsprüfer, Steuerberater or vereidigter Buchprüfer, under its audit guidelines. The deadline moves to the next working day if 15 May falls on a weekend or holiday, and no extension is possible. And for reporting year 2026 the declaration is filed formally under the VerpackDG but in substance under the Verpackungsgesetz, which matches section 68(5): for packaging made available in 2026, only section 10 applies, and the data follow the old law’s material breakdown.

Recycled content in PET bottles. Section 45(1) allows producers to place single-use plastic drink bottles made mainly of PET on the German market only if they contain at least 25% recycled plastic by mass. Section 45(2) raises this to 30% from 1 January 2030 and drops the PET qualifier, so it reaches all single-use plastic drink bottles (gesetze-im-internet.de). A consolidated text of section 45(3) allows the share to be met across a producer’s annual volume, with records of recyclate type and mass shown to the Land authority on request. The EU targets in PR-EU-004 run in parallel; the deposit return piece covers the German deposit those bottles sit in.

The reusable offer. Section 60 requires final distributors that fill food into single-use plastic food packaging or drinks into single-use cups at the point of sale to offer the same goods in reusable packaging, including lids for cups. The reusable option may not be offered at a higher price or on worse terms than the single-use one, and clearly visible signs must tell customers about it, with the same notice in the media used for deliveries. Staff vending machines in non-public business premises are exempt. Section 61, in its consolidated text, lets shops with no more than five employees and a sales area of 80 m2 or less meet the duty by filling customers’ own containers.

In practice: McDonald’s.

The SPI Buyers Database records 1,382 German restaurants at year-end 2025, with takeaway food containers and cups under the single-use plastic fund levy of PR-DE-002 and LUCID registration under PR-DE-001 from 12 August 2026. It also records a EUR 2 deposit on reusable cups and lids in Germany. That is the shape section 60 asks of every takeaway seller: a reusable route at the same price, alongside a levy on the single-use route.

Enforcement: three fine bands and a delayed list

Section 66 sets the fine ceilings, and section 67 allows confiscation. The Länder prosecute offences through the authority their own law names, according to the Umweltbundesamt page recorded in SPI’s rule note.

Maximum fines per offence as written in section 66(3). Numbers refer to the items in section 66(1) and (2). SPI has found no published fine under the VerpackDG as of 24 October 2026.

A second enforcement route works through the market rather than the courts. Section 13 bars distributors and fulfilment service providers from handling packaging of producers not properly registered, and the register’s automated check supports that bar (SPI rule note PR-DE-001). For a marketplace seller, a missing LUCID entry is therefore a delisting risk before it is a fine risk.

SPI analysis

The six-month gap before section 66(2) applies gives companies a defined window. The items in the second list include the upper band, so the practical deadline for any process that section 66(2) touches is 12 February 2027, not the general start date.

The single-use plastic fund: rates and money

The Einwegkunststofffondsgesetz, published in May 2023, implements Article 8 of the SUP Directive through a public fund rather than private schemes. Producers of listed single-use plastic products register on the UBA’s DIVID platform, report the previous year’s mass by 15 May, and pay a levy set by UBA notice. Rates are in section 2 of the Einwegkunststofffondsverordnung, which the Bundestag received as Drucksache 20/8128 (Exhibit 7).

Rates as set in the ordinance in force since 1 January 2024. BMUKN says rates are reviewed by the end of 2026; SPI has not yet confirmed any amended rate.

The rates follow litter cost, not material cost. A deposit-bearing drink container pays EUR 0.001 per kg because few are littered, while a container without deposit pays EUR 0.181, 181 times as much. Cups, at EUR 1.236, pay 7.0 times the food container rate of EUR 0.177. The UBA page gives a calculated rate of EUR 0.691 per kg for fireworks with plastic parts, to be set in the ordinance by the end of 2026; BMUKN says fireworks become levy-liable from 2027 and that rates are first reviewed by the end of 2026. SPI has not yet confirmed an amended ordinance.

Two scope decisions since 2024 narrow the base. On 3 November 2025 the UBA introduced a 500 gram threshold by administrative regulation: bags, wrappers and food containers with contents over 500 grams no longer pay the levy. The UBA’s announcement says empty food containers such as takeaway boxes and salad bowls also fall under the threshold; its administrative rule (version of 23 March 2026) adds that a container sold empty stays liable unless the producer shows in the individual case that it is actually filled with more than 500 grams. The UBA’s example is the film around a 750 gram Christmas stollen. The second is the classification route: borderline products are judged against the Commission’s SUP guidelines, or by a binding, fee-based UBA classification (BMUKN).

The estimate is a ceiling in the ordinance's explanatory part, not an outturn. Revenue and administrative costs for 2024 are as stated by VKU, a trade body; SPI has not yet confirmed them in a UBA publication. One currency throughout.

In practice: the Einwegkunststofffonds.

The UBA set a point value of EUR 0.274 on 28 August 2026 and expected to pay about EUR 205 million to municipalities and public waste bodies. On 2 October 2026 it said the point value had been miscalculated because of a software fault, that issued notices would be withdrawn, that the total would not change, and that payment would come at the start of 2027 instead of the end of 2026 (UBA press release 22/2026). The municipal utilities association VKU had put 2024 revenue at about EUR 216 million, administrative costs at about EUR 11 million and the originally planned fund volume at about EUR 430 million (VKU, 13 May 2026). For producers the delay changes nothing: the 2025 report was due by 15 May 2026 and the levy is owed whatever happens to the payout.

SPI analysis

Revenue at about half the estimate cuts two ways for a rate review. It may show that reported masses are lower than modelled, which argues for stable rates; or it may show gaps in registration, which argues for more enforcement before any rate change. SPI has not yet confirmed which way BMUKN reads it.

The plastic packaging tax: what is reported, what is confirmed

SPI separates the plastic packaging tax into what an official text says and what the press reports. As of 24 October 2026 the first column is almost empty. SPI found no Bundestag Drucksache and no finance ministry publication for a Kunststoffverpackungsteuergesetz. What exists is a draft “Formulierungshilfe” with a working date of 30 September 2026, posted by the trade title packaging-journal.de, press reports from 5 October onwards, and an association statement of 9 October 2026. Exhibit 9 sets out each point and its status.

Status as of 24 October 2026. Reported means a press report or an unofficial draft; SPI has not yet confirmed it in a Bundestag or finance ministry text. The rate does not appear in the part of the draft SPI read.

The rate. Tagesspiegel reported on 5 October 2026 a tax of EUR 550 per 1,000 kg of plastic from 1 July 2027, and ad-hoc-news and recycling.de repeated the figure. The draft text SPI read describes a tax measured on the weight of plastic contained in the packaging, but the sections SPI could read do not state the rate. The association statement of 9 October does not state it either. SPI therefore treats EUR 550 per tonne as reported and has not yet confirmed it.

The design. According to the draft, Article 1 enters into force on 1 January 2027 and the tax applies to taxable events after 30 June 2027, with the 2027 tax due in August 2027. The base would be plastic packaging and films, plus composite packaging where the plastic share exceeds 5%; free transfers between private individuals would be exempt; and customs offices would administer it. The draft opens by citing the cabinet’s decision of 6 July 2026 on the 2027 budget and plan to 2030, and links the revenue to the amount Germany pays the EU under the plastic own resource. The plastic packaging taxes piece explains that EUR 0.80 per kg contribution (PR-EU-017) and the taxes Spain, Italy and the UK built on it.

The money and the cost. The draft estimates federal revenue of EUR 805 million at full-year effect in 2027 and EUR 670 million in the cash year, then EUR 1,485 million (full year) and EUR 1,505 million (cash) in 2028, falling to EUR 1,415 million by 2031. It puts business compliance cost at about EUR 8.837 million once and EUR 44.103 million a year, and new posts at 788 in customs, 28 at the federal IT service and 3 at the finance ministry. The 33 associations argue that 819 posts are too few and that a realistic control effort would need more than 1,300; Kleeberg reports that the customs union expects about 2,000.

The vehicle and the hearing. Press and the associations describe the tax as an amendment to the Haushaltsbegleitgesetz 2027, Bundestag Drucksache 21/7860. The Bundestag’s own report on the budget committee hearing of 12 October 2026 lists higher duties on alcohol, sparkling wine and alcopops as the bill’s tax measures and does not mention plastic. It adds that the finance committee has set its own hearing on the tax measures for 9 November 2026 (Bundestag text archive; hib 811/2026). The 9 November date is therefore confirmed for that hearing; SPI has not yet confirmed that the plastic packaging tax will be on its agenda.

The politics. ms-aktuell reported on 17 October 2026 that a cabinet decision planned for 14 October was postponed after resistance from the CDU/CSU parliamentary group, whose leader called the draft not approvable in its current form. Kleeberg reported on 19 October that at least 24 CDU/CSU members would not back it as drafted and that the coalition groups still had to agree the design. Reports also differ on which ministry leads: Tagesspiegel names the environment ministry, ad-hoc-news the finance ministry. SPI has not yet confirmed either.

Industry reaction

“Eine Steuer setzt keine Investitionsanreize für nachhaltigere Verpackungen oder zusätzliche Recyclingkapazitäten.”

In English: “A tax sets no investment incentives for more sustainable packaging or additional recycling capacity.”

33 German business associations and the BDZ customs union, joint statement on a plastic packaging tax, 9 October 2026

The statement lists 34 signatories, 33 associations and the BDZ Deutsche Zoll- und Finanzgewerkschaft, with Allianz Verpackung und Umwelt named at the top. It argues that the tax adds bureaucracy on top of EPR and the PPWR, disadvantages German packaging makers against foreign supply chains, and could overlap with eco-modulated fees under the VerpackDG. It also says:

“Die Kunststoffverpackungssteuer wäre somit in erster Linie eine weitere Kostenbelastung der privaten Haushalte.”

In English: “The plastic packaging tax would therefore be above all a further cost burden on private households.”

33 German business associations and the BDZ customs union, joint statement on a plastic packaging tax, 9 October 2026

On the VerpackDG, the Länder chamber accepted the timing while objecting to the content:

“Der Bundesrat hält ein rechtzeitiges Inkrafttreten des Verpackungsrecht-Durchführungsgesetzes ebenfalls für erforderlich, um Unsicherheiten für die Wirtschaft und den Gesetzesvollzug zu vermeiden.”

In English: “The Bundesrat also considers timely entry into force of the Packaging Law Implementation Act necessary, to avoid uncertainty for business and for enforcement.”

Bundesrat, resolution on the VerpackDG, Drucksache 377/26 (Beschluss), 10 July 2026

And on the fund, the regulator explained the delay in one line:

“Aufgrund eines Berechnungsfehlers muss dieser Punktewert neu ermittelt werden.”

In English: “Because of a calculation error, this point value must be recalculated.”

Umweltbundesamt, press release 22/2026 on the single-use plastic fund, 2 October 2026

Plastics bodies have added a different line of criticism. recycling.de reported on 22 October 2026 that IK, Plastics Europe Deutschland and VDMA see an import gap, with packaging on imported filled goods possibly outside the tax while domestic and empty imported packaging pays, and that the recycling association bvse wants recyclate exempted from the start.

Scenarios: the levy and the reported tax on one basket

SPI priced one 50-tonne basket of plastic packaging for a hypothetical takeaway operator in Germany. The basket is an SPI assumption, not a market average: 38 tonnes are fund products and 12 tonnes are other plastic packaging, such as stretch film and secondary film, that the fund does not reach (Exhibit 11).

Exhibit 11SPI calculation: cups are a fifth of the basket's weight but more than half of its EUR 22,908 levy

EUR, rate per kg times kg. All fund items assumed under the 500 gram threshold and placed by a German producer. Dual system fees left out because they are private.

Cups are 20% of the weight and 54.0% of the levy. At the reported tax rate of EUR 0.55 per kg, a 10 gram cup would carry 0.55 euro cent of tax against 1.236 euro cent of levy, so the reported tax per kg is 44.5% of the cup levy rate but 3.1 times the food container rate. That is why the tax would change the bill most for operators heavy in containers and film.

Exhibit 12 sets out five cases.

Exhibit 12SPI calculation: the reported tax would add EUR 13,750 in 2027 and EUR 27,500 in 2028 to the basket, less if recyclate relief or an import gap applies

EUR. The tax rate, start date, recyclate relief and import treatment are reported, not confirmed. Recyclate case: 30% of plastic weight is recyclate and fully relieved from 1 July 2028, an SPI assumption about a mechanism SPI has not yet confirmed. Import case: the 12 t of other packaging arrive on imported filled goods and fall outside the tax, as plastics bodies say the draft allows.

Three readings follow. The tax, if adopted as reported, would be larger than the levy on this basket from its first full year. Recyclate relief that starts a year after the tax would be worth EUR 4,125 in 2028 on these assumptions, less than a sixth of the tax. And the import treatment is worth more than the recyclate relief: EUR 6,600 a year on 12 tonnes, which is why domestic converters object to it. All figures are in euro; none are summed with any other currency.

A framework: four German producer positions

SPI groups producers by two tests: whether their packaging ends up with households (and so needs a dual system), and whether it includes fund products. The plastic tax, as reported, would cut across all four.

Exhibit 13SPI's four positions: every producer registers in LUCID, but the levy and the reported tax land very differently

Positions are SPI's planning segmentation, not legal categories. Tax exposure is shown only as reported. Check your position with the Zentrale Stelle, the UBA or counsel.

In practice: Henkel.

The SPI Buyers Database records Henkel’s headquarters in Düsseldorf and names Weisser Riese and Gliss among its brands; under the VerpackDG it registers in LUCID and finances recycling of its household laundry and hair care packaging through system participation. That is position 1: no fund levy on these packs, but a direct exposure to the plastic weight of bottles and refill pouches if the reported tax comes, and to recyclability-based fees once section 26a ordinances are made.

Position 4 has the longest runway and the least visible deadline. Producers of packaging outside system participation may operate without section 19 approval until 31 December 2027, and other producer responsibility organisations until 31 October 2027; approval carries a fee (Zentrale Stelle). The Zentrale Stelle’s 2026 minimum standard on recyclable design, published under section 26 and in place for systems from 31 August 2026, is meanwhile the reference for fee modulation until BMUKN issues ordinances under section 26a, which need the Bundesrat’s consent. SPI has not yet confirmed any draft of those ordinances.

What leaders should do now

  1. Compliance teams, by 12 November 2026: check every LUCID entry against section 6, including brand names and, for foreign producers, the authorised representative, because section 68(2) sets that date for changes.
  2. Procurement and finance, by 31 December 2026: confirm that each dual system contract runs under the VerpackDG from 1 January 2027, since old-law participations end at the latest on that date; budget system fees from your own contracts, as no public tariff exists.
  3. Takeaway and food service operators, now: audit each site for the section 60 reusable offer at no higher price, the signs it requires and the delivery-channel notice, and record which sites use the section 61 small-shop route.
  4. Finance teams, by 15 May 2027: file the 2026 declaration of completeness through a registered auditor and the 2026 fund report on DIVID, applying the 500 gram threshold; budget the levy at the current EWKFondsV rates and watch for the review due by the end of 2026.
  5. Drinks producers, before the 2030 artwork and resin cycles: plan for 30% recycled content in all single-use plastic bottles from 1 January 2030, not only PET, and keep the annual-volume records that section 45(3) allows.
  6. Tax and public affairs teams, through 9 November 2026 and after: follow the finance committee hearing and any Drucksache or amendment that adds a plastic packaging tax; model it as a scenario at the reported rate and check with counsel before booking any cost.
  7. B2B packaging producers, by 31 October 2027: decide between section 19 approval and an oPRO, because the oPRO transition closes two months before the producer one.

Questions for your board

  • Are all our German system contracts on a VerpackDG basis for 1 January 2027, and who signed off on that?
  • Does every company in our group that sells into Germany have a correct LUCID entry, and do our foreign entities have an authorised representative?
  • What will our 2026 fund levy be at the current rates, and how much does the 500 gram threshold remove?
  • If a plastic packaging tax were adopted as reported, how many tonnes of our plastic would it reach, and how much of that arrives on imported filled goods?
  • Are we offering reusable options at every German takeaway point of sale on the same terms as single-use?
  • Is our 2030 recycled content plan for drink bottles based on the German 30% rule for all plastic bottles?

What to watch

  • 9 Nov 2026: Bundestag finance committee hearing on the tax measures of the Haushaltsbegleitgesetz 2027; SPI has not yet confirmed that the plastic tax is included.
  • 12 Nov 2026: deadline under section 68(2) for changes to LUCID register data.
  • 31 Dec 2026: old-law system participations end at the latest; review of the fund’s levy rates due; fireworks rate to be set.
  • Early 2027: UBA payout of about EUR 205 million from the fund, after the recalculation.
  • 12 Feb 2027: section 66(2) fines apply.
  • 15 May 2027: declarations of completeness and fund reports for 2026 due.
  • 1 Jul 2027: reported start of the plastic packaging tax, not confirmed.
  • 31 Oct 2027 and 31 Dec 2027: approval transitions end for other producer responsibility organisations and for producers outside system participation.

Methodology

  • Data used: the VerpackDG text on gesetze-im-internet.de (sections 6, 9, 10, 26, 26a, 45, 60, 66 and 68), Bundestag Drucksachen 21/5346 and 20/8128, Bundesrat Drucksache 377/26, Bundesregierung, Zentrale Stelle, BMUKN and UBA pages, Bundestag reports of 12 October 2026, the association statement of 9 October 2026, a draft Formulierungshilfe of 30 September 2026 posted by the trade press, press reports from 5 to 22 October 2026, and SPI rule notes PR-DE-001 and PR-DE-002 and the Germany jurisdiction note of 14 October 2026. Consulted 24 October 2026 unless stated.
  • Counting rules: EUR only; levy as rate per kg times kg; no currency conversion and no sum with any other currency.
  • Basket: a 50-tonne SPI assumption (Exhibit 11). Dual system fees are excluded because they are private and unpublished.
  • Scenarios: the tax lines use the reported EUR 550 per tonne and reported dates; the recyclate and import cases rest on SPI assumptions stated in Exhibit 12.
  • Framework: the four positions are SPI choices for planning.
  • Cut-off: 24 October 2026.
  • Limitations: SPI has not yet confirmed any official text of the plastic packaging tax, its rate, its legislative vehicle or its place on the 9 November agenda; any amended EWKFondsV; the 2024 fund revenue in a UBA publication; or any section 26a ordinance. Section 61 thresholds come from a consolidated text, not the official site. This is not legal advice; check with counsel where it applies.

FAQ

Has the VerpackDG replaced the Verpackungsgesetz?

Yes. The Verpackungsrecht-Durchführungsgesetz of 13 July 2026 (BGBl. 2026 I Nr. 207) has applied since 12 August 2026, the same day as the PPWR. The Bundestag adopted it on 11 June 2026 and the Bundesrat let it pass on 10 July 2026. Transitional rules in section 68 run to 31 December 2027.

Who must file a declaration of completeness?

Producers that placed at least 80 tonnes of glass, 50 tonnes of paper and board or 30 tonnes of other materials in the previous year. They file by 15 May, checked by an auditor registered with the Zentrale Stelle, and no extension is possible. For 2026 the filing follows the old law’s content.

What does Germany's single-use plastic levy cost?

Rates per kg are set in section 2 of the EWKFondsV: EUR 0.177 for food containers, EUR 0.876 for bags and wrappers, EUR 1.236 for cups, EUR 3.801 for lightweight carrier bags and EUR 8.972 for tobacco filters. Deposit drink containers pay EUR 0.001. Items with contents over 500 grams are outside the levy.

Is there a German plastic packaging tax?

Not as of 24 October 2026. Press reports describe EUR 550 per tonne of plastic from 1 July 2027 through the Haushaltsbegleitgesetz 2027, but SPI has not yet confirmed any Bundestag or finance ministry text, and a cabinet decision was reported postponed in mid-October.

When is the Bundestag hearing on the plastic tax?

The Bundestag says its finance committee has set a hearing on the tax measures of the Haushaltsbegleitgesetz 2027 for 9 November 2026. SPI has not yet confirmed that the plastic packaging tax will be part of that hearing.

What recycled content must German PET bottles contain?

Section 45 VerpackDG requires at least 25% recycled plastic by mass in single-use drink bottles made mainly of PET. From 1 January 2030 the minimum is 30% for all single-use plastic drink bottles, and producers may meet it across their annual volume.
